RECOMMENDATION: Adopt the attached resolution approving sole source purchase of (ZMC) Heart Monitors and related equipment. BACKGROUND: In November 2005 Kaiser granted $137,500 to the San Rafael Fire Department to purchase 12 lead capable heart monitors and related monitors and equipment. The funds have been received and are in an approved City Account. The 12 lead monitor system is needed to evaluate patients for emergency angioplasty reducing the chance of major invasive surgery The Department currently uses older versions of the (ZMC) Heart Monitors and wishes to continue using the company's product in order to maintain uniformity and the viability of our stock of related equipment, valued at approximately $8,000. (Batteries, electrode wires, battery charges and defibrillation pads). The Fire Department has approximately 10 years of experience and training with (ZMC) heart monitors. This experience has developed into a high level of confidence that results in more effective and efficient use that benefits the patient. Neighboring paramedic response agencies also use the same manufacturer. The departments experience has demonstrated that Zoll monitors are very user friendly and dependable under very rugged conditions. Through research, the department has determined that a competitive brand has not proven to be sufficiently durable to justify the disposal of our current inventory, the need to alter product familiarity and training or to use equipment that differs from our neighbors. The major component of this purchase will be four 12 lead monitors at a cost of approximately $115,000. In addition there will be need for compatible automatic defibrillators and equipment or supplies the department hopes to obtain within the allotted grant. A change of manufacturer would require a change out of the current supply inventory which would result in the loss of approximately $8,000. The department finds that there will be need from time to time to exchange use with neighboring agencies, therefore there will be less chance of inappropriate use. Department experience has demonstrated an excellent record of dependability that should be continued. The fire department has 10 years of training in the use of Zoll monitors and a change in manufacturer will require more than technology upgrade training that could foster inefficient field use for some time. Accordingly, this purchase qualifies as a "sole source" procurement exempted by the City's bidding requirements pursuant to Municipal Code Section 2.55.070. FISCAL IMPACT: This purchase will be funded by a grant from Kaiser Permanente Hospitals in the amount of $137,500. ACTION REQUIRED: Adopt the proposed Resolution. Encls. Whereas, recent advancements in advanced cardiac care have demonstrated the importance of early acquisition and interpretation of 12 -Lead electrocardiograms; and, Whereas, current Fire Department heart monitors do not have the capability to perform 12 -Lead functions, requiring the purchase of new devices; and Whereas, new equipment that is compatible with existing equipment and supplies is only available from Zoll Medical Corporation; and Whereas, the City Council finds it is appropriate to waive public bidding pursuant to Section 2.55.070D of the San Rafael Municipal Code, and to authorize a sole -source purchase from Zoll Medical Corporation of new, 12 -Lead capable heart monitor/defibrillators that are only compatible from that source; NOW, THEREFORE BE IT RESOLVED, that the City Manager of said City be authorized and directed to execute a purchase order or agreement, in a form approved by the City Attorney, for the purchase of four 12 -Lead capable heart monitor/defibrillators and associated equipment with Zoll Medical Corp., in an amount not to exceed $137,500. BE IT FURTHER RESOLVED that the Interim City Manager is hereby authorized to take any and all such actions and make changes and expedite such agreements, in a form as approved by the City Attorney, as may be necessary to accomplish the purpose of this resolution.
