Meeting Date: December 20, 2010 SAN RAFAEL CITY COUNCIL AGENDA REPORT Department: PublicWorks Prepared by: �� ''7 City Manager Approval: Director of Public Works File No. 16.01.228 SUBJECT: ACCEPT COMPLETION OF THE DOMINICAN/BLACK CANYON NEIGHBORHOOD LANDSCAPING PROJECT, PROJECT #11059 AND AUTHORIZE THE CITY CLERK TO FILE THE NOTICE OF COMPLETION. RECOMMENDATION: Staff recommends that the City Council accept completion of the project and authorize the City Clerk to file the Notice of Completion. BACKGROUND: The landscaping planter areas on the east side of Highway 101 sound wall near Belle and Villa Avenue's as well as the planting area at the elbow of Elm Street have been completed in conformance with the plans and specifications. These planter areas were planned to be landscaped by CalTrans in 1971 however they were never constructed due to lack of State funding. The City pursued a Grant supporting 90% of the project cost from Caltrans for an estimated total cost of $128,000 in October 2004. However; Caltrans High Occupancy Vehicle Project delayed this landscape project for several years while Caltrans decided whether they would relocate the sound wall or not. On February 23, 2009 Caltrans approved encroachment permit for construction of this project. This project plans were reviewed and approved by MMWD. Bids for Dominican f Black Canyon Neighborhood Landscape Project were opened on April 28, 2009 and awarded to Fieldstone Construction Co. on May 18, 2009. The City Council adopted Resolution number 12744 authorizing the Public Works Director to enter into an agreement with Fieldstone Construction Co. to construct the above mentioned Landscaping project. This project is strongly supported by the residents of the Dominican Black Canyon neighborhoods who have been forced to live with the impact of this incomplete project for the past 38 years and tirelessly worked to make this project happen. PROJECT UPDATE: The project construction was fully completed (including all punch list items and plant establishment period) on December 1, 2010. We recommend that the City Council accept the project and instruct the Clerk to proceed recoding the attached Notice of Completion. Change Orders 1, 2, & 3: After the start of construction several change orders were necessary to complete the project. Several of the tree species needed to be modified to be able to survive in the location chosen. Controller modifications were necessary to bypass buried man made objects. In addition, the project scope at Villa Avenue was expanded 800 feet south and included additional asphalt and drainage work. ANALYSIS: Pursuant to Civil Code Section 3093 the City, owner of the improvements, is required to record a Notice of Completion upon acceptance of the improvements by the City. This acceptance initiates a time period during which project sub contractors may file Stop Notices seeking payment from the City out of the funds owed to the Contractor for the project work. ACTION REQUIRED: Accept completion of the Dominican/Black Canyon Neighborhood Landscaping Project, Project (Project #11159) and authorize the City Clerk to file a Notice of Completion.
