SUBJECT: ACCEPT COMPLETION OF THE ADA -DOJ COMPLIANCE CURB RAMPS
2009-2010 PROJECT, CITY PROJECT #15006, AND AUTHORIZE THE CITY CLERK TO FILE
THE NOTICE OF COMPLETION.
RECOMMENDATION:
Staff recommends that the City Council accept completion of the project and authorize the City Clerk to
file the Notice of Completion.
BACKGROUND:
In 2004 the City of San Rafael entered into a Settlement Agreement with the federal Department of
Justice which required the construction of curb ramps for each resurfacing project undertaken since 1992.
The Settlement Agreement identified a backlog of 800 curb ramps, 128 of which were completed during
this project.
The ramps were designed by Department of Public Works engineering staff. On May 3, 2010 the City
Council adopted the project plans and specifications which were advertised in accordance with San
Rafael's Municipal code and policies on May 7, 2010. Bids were opened on June 2, 2010 at 2:30 PM.
The City Council adopted Resolution number 12974 authorizing the City Manager to enter into an
agreement with FBD Vanguard Construction Inc. (the low bidder). Construction commenced on August
9th, 2010.
PROJECT UPDATE:
Construction was completed (including all punch list items) on March 15, 2011. The engineer
recommends acceptance of the project and recordation of a Notice of Completion.

The price the City received for constructing curb ramps for this project was very competitive
and, based on the intent to complete as many curb ramp modifications as possible, an additional
15 curb ramps were added (originally only 113 were to be installed). These additions brought
the project over its original approved budget of $523,274.13 by $8,400.25. Public Works will
identify other capital project finds to pay the overage.

ANALYSIS:
Pursuant to Civil Code Section 3093 the City, owner of the improvements, is required to record a
Notice of Completion upon acceptance of the improvements by the City. This acceptance
initiates a time period during which project sub -contractors may file Stop Notices seeking
payment from the City out of the finds owed to the Contractor for the project work.
ACTION REQUIRED:
Accept completion of the ADA -DOJ Compliance Curb Ramps 2009-2010 Project, (Project
#15006) and authorize the City Clerk to file a Notice of Completion.
