SUBJECT: ACCEPT COMPLETION OF THE FREITAS PARK RENOVATIONS PHASE II,
PROJECT NO. 10732, AND AUTHORIZE THE CITY CLERK TO FILE THE NOTICE OF
COMPLETION.
RECOMMENDATION:
Staff recommends that the City Council accept completion of the project and authorize the City Clerk to
file the Notice of Completion.
BACKGROUND:
On February 22, 2011, the City Council adopted the project plans and specifications, which were
advertised in accordance with the City of San Rafael's Municipal Code and policies on February 25,
2011. Bids were opened on March 17, 2011 at 10:00 AM and read aloud. On March 21, 2011, the City
Council adopted Resolution No. 13120 authorizing the Public Works Director to enter into an agreement
with Ghilotti Brothers, Inc., and construction commenced on May 18, 2011.
PROJECT UPDATE:
Construction was completed on September 9, 2011 within the originally authorized construction budget
of $190,880.00. The total project cost, including design, construction and the playground equipment
purchased by the City, was $255,527.14. On March 21, 2011 the City Council authorized a total budget
of $251,906.00 for this project. The additional $3,621.13 associated with the project was due to the actual
price and shipping of the playground equipment and furniture. This additional cost will be paid for using
neighborhood contributions.

All work was completed within the amount of working days specified. We recommend acceptance of the
project and recordation of a Notice of Completion.
ANALYSIS:
Pursuant to Civil Code Section 3093 the City, owner of the improvements, is required to record a Notice
of Completion upon acceptance of the improvements by the City. This acceptance initiates a time period
during which project sub -contractors may file Stop Notices seeking payment from the City out of the
funds owed to the Contractor for the project work.
ACTION REQUIRED:
Accept completion of the Freitas Park Renovations Phase II Project, (Project #10732) and authorize the
City Clerk to file a Notice of Completion.

NOTICE IS HEREBY GIVEN for and on behalf of the City of San Rafael, County of Marin, State of
California, that there has been a cessation of labor upon the work or improvement and that said work
or improvement was completed upon the 9th day of September, 2011 and accepted the 17th day of
