SUBJECT: REPORT ON BID OPENING FOR THE POINT SAN PEDRO MEDIAN
LANDSCAPING IMPROVEMENTS, CITY PROJECT NO. 11163 (BID OPENING
HELD ON THURSDAY, APRIL 26, 2012) AND RESOLUTION REJECTING ALL
BIDS, AUTHORIZING PUBLIC WORKS DEPARTMENT TO READVERTISE AND
INSTRUCT CITY CLERK TO REBID THE PROJECT
RECOMMENDATION: Adopt resolution
BACKGROUND:
On June 22, 2011 the City Council adopted Resolution 13181 establishing the Pt. San Pedro Road Median
Landscaping Assessment District. On November 21, 2011 the City Council authorized the Public Works
Director to enter into an agreement with Abey Arnold Associates to design the project.
On April 2, 2012 the City Council adopted the plans and specifications and authorized the City Clerk to
call for bids. The project was advertised in accordance with San Rafael's Municipal Code on April 6,
2012 and bids were publicly opened on April 26, 2012 at 2:00 PM and read aloud. The engineer's
estimate was $1,606,000. The following bids were received:

Upon tabulation of the bid results, staff found an error in the bid documents and irregularities in the
quantities. The clerical error in the quantity would increase project cost by more than $150,000 which is
in excess of the percent allowable by the Public Contract Code. In addition, other minor irregularities
were found in the submitted bids.
Additional language to clarify this problem has been added to the specifications. With these corrections
in place the project is ready to be rebid immediately. This minor delay should not significantly delay the
project, and it is anticipated that construction will be completed by October 2012.
Following a short bid cycle, the Department of Public Works anticipates returning to Council June 4,
2012 to request authorization to acquire bonds to fund the project.
FISCAL IMPACT:
There is no fiscal impact for rejecting the bids received.
ACTION REQUIRED:
It is recommended to reject all bids and instructing staff to rebid the project with modifications to the
specification.

RESOLUTION NO. 13339
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
REJECTING ALL BIDS FOR THE POINT SAN PEDRO MEDIAN LANDSCAPING
IMPROVEMENTS PROJECT, PROJECT NO. 11163, AND AUTHORIZING CITY
CLERK TO REBID THE PROJECT
WHEREAS, on the 26`h day of April, 2012, pursuant to due and legal notice published
in the manner provided by law, inviting sealed bids for proposals for the work hereinafter
mentioned, as more fully appears from the Affidavit of Publication thereof on file in the office of
the City Clerk of the City of San Rafael, California, the City Clerk of said City did publicly open,
examine, and declare all sealed bids or proposals for doing the following work in said City, to
wit:
"POINT SAN PEDRO MEDIAN LANDSCAPING IMPROVEMENTS"
PROJECT NO. 11163
in accordance with the plans and specifications therefore on file in the office of said City Clerk;
and
and
WHEREAS, an error was found in the bid documents and irregularities in the quantities;
WHEREAS, correction of the irregularity would cause the bids to increase in excess of
the allowable percentage per the California Public Contract Code; and
WHEREAS, the San Rafael Municipal Code section 11.50.100 states that the awarding
authority has the sole discretion to reject all bids.
NOW, THEREFORE, IT IS HEREBY ORDERED AND RESOLVED that all bids
received for the Point San Pedro Median Improvements Project be rejected in accordance with
the San Rafael Municipal Code section 11.50.100, and authorize City Clerk to rebid the project.
RESOLVED FURTHER, that the Public Works Director is hereby authorized to take
any and all such actions and make changes as may be necessary to accomplish the purpose of this
resolution.
