SUBJECT: ACCEPTANCE OF MAYOR PHILLIPS' APPOINTMENT OF NANCY
MACKLE AND RICHARD LANDIS TO THE REDEVELOPMENT SUCCESSOR AGENCY
OVERSIGHT BOARD AND THE APPOINTMENT OF JIM SCHUTZ AND KATIE KORZUN
AS ALTERNATE MEMBERS
RECOMMENDATION: Accept the Mayor's appointment of Nancy Mackle, City Manager
and Richard Landis, Administrative Manager to the Redevelopment Successor Agency Oversight
Board and the appointment of Jim Schutz and Katie Korzun as alternative members.
BACKGROUND: As a result of the California Supreme Court decision in California
Redevelopment Association, et al. v. Ana tMatosantos, et al, Case No. 5194861, each
redevelopment agency within the State of California was dissolved and no longer exists as of
February 1, 2012, in accordance with Part 1.85 of Division 24 of the Health and Safety Code,
added by Assembly Bill 1X26.
In accordance with Health and Safety Code Section 34173, the City of San Rafael has elected to
serve as the successor agency to the San Rafael Redevelopment Agency ("Agency") to wind
down the affairs of the Agency. The successor agency's activities are subject to review and
approval by an oversight board.
Health and Safety Code Section 34179(a) provides that the oversight board will be comprised of
seven political appointees from affected local taxing entities and the community that created the
redevelopment agency, as follows:
1. One member appointed by the county board of supervisors.
2. One member appointed by the mayor for the city that created the redevelopment agency.
3. One member appointed by the largest special district, by property tax share, with territory
in the territorial jurisdiction of the redevelopment agency that is eligible to receive
property tax revenues pursuant to Section 34188.

4. One member appointed by the county superintendent of education.
5. One member appointed by the Chancellor of the California Community Colleges;
6. One member of the public appointed by the county board of supervisors; and
7. One member representing the employees of the former redevelopment agency appointed
by the mayor or chair of the board of supervisors, as the case may be, from the
recognized employee organization representing the largest number of former
redevelopment agency employees employed by the successor agency at that time.
On April 2, 2012, Mayor Phillips appointed City Manger Nancy Mackle and Economic
Development Manager Stephanie Lovette to the Oversight Board. Ms. Mackle was the mayoral
appointee and Ms. Lovette was the representative for the former redevelopment agency
employees. After consultation with other cities and counsel to the Successor Agency, staff
recommends that Ms. Lovette serve as staff to the Oversight Board instead of serving as a board
member. Staff is recommending that Mr. Landis serve as the mayoral appointee and Ms. Mackle
serve as the representative for the former redevelopment agency employees. Staff is also
recommending the appointment of alternative members.
STAFF RECOMMENDATION: Accept the Mayor's appointment of Nancy Mackle, City
Manager and Richard Landis, Administrative Manager to the Oversight Board and the
appointment of Jim Schutz and Katie Korzun as alternative members.
FISCAL IMPACT: There is no cost to the City. Pursuant to Health and Safety Code Section
34179(c), the Successor Agency is responsible for the administrative cost of the oversight board.
These costs can be paid from the $250,000 administrative cost allowance, thereby reducing the
funds available for activities to wind down the former redevelopment agency.
ACTION REQUIRED: Accept the Mayor's appointments to the Oversight Board.
