RECOMMENDATION: Adopt Plans and Specifications for the project and authorize the City Clerk to call for bids. BACKGROUND: The Non -Motorized Transportation Pilot Program (NTPP), funded through federal transportation legislation in 2005 (SAFETEA-LU), allocated $25 million to four communities nationwide including Marin County. The pilot program was initiated locally in the summer of 2006 by the Marin County Department of Public Works. The Mahon Creek Path to Transit Center Connector Project is one of 50 NTPP projects, chosen out of over 200, to be implemented in Marin County. On April 21, 2008 the City Council adopted Resolution number 12476, authorizing the Director of Public Works to enter into an agreement with Alta Planning and Design, Inc. to design the Mahon Creek Path to Transit Center Connector Project. Improvement alternatives were developed and presented to stakeholders including the San Rafael Bicycle and Pedestrian Advisory Committee (BPAQ, the San Rafael Americans with Disabilities Act (ADA) Committee, and the Marin County Bicycle Coalition (MCBC). On February 17, 2009, Council adopted a resolution approving City Staff and Consultants' "preferred design alternatives" and directing staff to proceed with preparation of the design plans and specifications. Alta Planning and Design, Inc. completed the design of the project and the plans and specifications have been signed and approved by the City Engineer. A copy is available at the City's Clerk's office for review. On July 31, 2012, Caltrans approved and issued the required documents allowing the City to proceed with bidding and construction of the project. FOR CITY CLERK ONLY FileNo.:— Council Meeting: Disposition: SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2 ANALYSIS: Adoption of the project pians and specifications is necessary for the pians to go out to bid and the construction of the project to begin. Construction is anticipated to commence during the spring of 2013. Typically, per San Rafael Municipal Code Section 11.50, contracts less than $125,000 do not require a formai procedure by which the City Clerk calls for bids by publishing a notice in a newspaper of general circulation. However, since this project is federally funded, the Caltrans Local Assistance Procedures Manual must be followed which states that "a minimum advertisement period of three weeks is required for all federal -aid projects" and that the "FHWA policy requires all bids to be opened publicly and read aloud". It is therefore recommended that this project follow the City of San Rafael's requirements for a "Major Contract" which also meets FHWA's federally funded project requirements. FISCAL IMPACT: The engineer's estimate for construction of the project is $52,000. The exact cost for construction will be determined after bids have been received at which time staff will request funding allocation. The City has received a grant through the NTPP for construction of this project and no local match is required.
