SUBJECT: CALL FOR APPLICATIONS TO FILL ONE CITY OF SAN RAFAEL ADVISORY MEMBER
POSITION ON THE MARIN COUNTY HAZARDOUS AND SOLID WASTE MANAGEMENT
JOINT POWERS AUTHORITY LOCAL TASK FORCE (CC)
BACKGROUND:
The Marin County's Hazardous and Solid Waste Management Joint Powers Authority (JPA) Local Task Force
(LTF) is to serve as an advisory committee to the JPA. The LTF provides viewpoints and concerns from
concerned geographical, interest -based and industry -associated members. Seats on the LTF include public
members from different areas of the County, solid waste haulers/facility operators, special districts, and one
member from an environmental organization.
The City of San Rafael, as outlined in the JPA governing documents, is allowed to appoint one citizen task force
member. Elissa Giambastiani, recently deceased, has served as the San Rafael LTF member since January,
2011.
RECOMMENDATION:
It is recommended that Council:
a) Call for applications to fill one City of San Rafael Advisory Member Position on the Marin County Hazardous
and Solid Waste Management Joint Powers Authority Local Task Force
b) Set deadline for receipt of applications for Tuesday, February 26, 2013 at 5:00 p.m. in the City Clerk's
Office, Room 209, City Hall; and
c) Set date for interviews of applicants at a Special City Council meeting to be held on Monday, March 4, 2013,
commencing at 5:30 p.m..
ACTION: Approve staff recommendation.

94901. The deadline for filing applications is Tuesday, February 26, 2013 at 5:00 p.m. in the
City Clerk's Office.
RESIDENTS OF THE CITY OF SAN RAFAEL ONLY MAY APPLY.
The purpose of the Local Task Force (LTF) is to serve as an advisory committee to the JPA.
The LTF provides viewpoints and concerns from geographical, interest -based and industry -
associated members. Seats on the LTF include public members from different areas of Marin
County, solid waste haulers/facility operators, special districts and one member from an
environmental organization. The LTF specifically assists in the review of the JPA's Integrated
Waste Management Plan, advises on emerging solid waste issues, and assist the Board with
Zero Waste Plan strategy development.
Interviews of applicants will be held at a Special Meeting of the San Rafael City Council on
Monday, March 4, 2013, commencing at 5:30 p.m., to fill the vacant position on the Local Task
Force.

PROCEDURES
SECTION 1— SUMMARY OF PURPOSES AND RESPONSIBILITIES
• Identify solid waste management issues of county -wide or regional concern
• Make recommendations to the JPA Board regarding updates and maintenance of
the County Integrated Waste Management Plan including the five-year review(s)
as set forth in Public Resources Code Sections 41770 and 41822
• Monitor and review proposed legislation related to integrated waste
management. If determined appropriate, propose recommendations to the Joint
Powers Authority Board regarding advocating for legislation that will assist the
County in meeting its goals pursuant to the California Integrated Waste
Management Act
• Consider recommendations to the Joint Powers Authority Board regarding
ordinances and/or minimum standards for possible adoption by local
jurisdictions to assist in meeting the goals according to the California Integrated
Waste Management Act and related legislation

The Marin County Hazardous and Solid Waste Management Joint Powers Authority
Board has determined that the Local Task Force membership shall include at least two
representatives of waste haulers, with two alternate members for those positions, three
representatives of environmental organizations, two representatives of special districts
involved in the regulation and disposal of waste, and five public representatives
appointed by the member agencies serving on the Joint Powers Authority Executive
Committee.
Local Task Force members shall be appointed by the Joint Powers Authority Board of
Directors, with the exception of the five public representatives which will be appointed
by the respective member agency serving on the Joint Powers Authority Executive
Committee.
SECTION 3 — MEETINGS
Local Task Force regular meetings will be held monthly on the first Wednesday of each
month in the offices of the Marin County Department of Public Works or other available
locations. All regular meetings shall comply with the noticing, agenda, and comment
requirements of the Brown Act (Government Code §54950 et seq.). Special meetings
may be called by the Chair or by a majority of the members, and held in accordance with
the requirements of the Brown Act.
SECTION 4 —QUORUM, VOTING, AND RULES OF ORDER
A quorum for the transaction of business shall exist when a majority of the appointed
members are present. When a quorum is present, action may be taken by the Local Task
Force upon the affirmative vote of a majority of the members present, unless a greater
voting requirement is prescribed by statute. Meetings of the Local Task Force shall be
governed by Robert's Rules of Order.
SECTION 5 — ELECTION OF OFFICERS, TERM, AND DUTIES
The officers of the Local Task Force shall be the Chair and Vice -Chair. Elections will be
held at the first meeting of the calendar year and the Chair and Vice -Chair will assume
responsibilities immediately. The term of the Chair and Vice -Chair shall be one year.
If at any time the Chair vacates this position, the Vice -Chair shall assume the role of
Chair for the remainder of the elected term and is authorized to appoint a new Vice -
Chair to serve the remainder of that elected term.

SECTION 40950
40950. (a) On or before March 1, 1990, and every five years
thereafter, each county, which is not a city and county, shall
convene a task force to assist in coordinating the development of
city source reduction and recycling elements prepared pursuant to
Chapter 2 (commencing with Section 41000), the county source
reduction and recycling element prepared pursuant to Chapter 3
(commencing with Section 41300), and to assist in the preparation of
the countywide siting element prepared pursuant to Chapter 4
(commencing with Section 41700).
(b) The membership of the task force shall be determined by the
county and by a majority of the cities within the county which
contain a majority of the population of the incorporated area of the
county, except in those counties which have only two cities, in which
case the membership of the task force is subject to approval of the
city which contains the majority of the population of the
incorporated area of the county. The task force may include
representatives Lves of the solid waste industry, environmental
organizations, the general public, special districts, and affected
governmental agencies.
(c) To ensure a coordinated and cost-effective regional recycling
system, the task force shall do all of the following:
(1) Identify solid waste management issues of countywide or
regional concern.
(2) Determine the need for solid waste collection and transfer
systems, processing facilities, and marketing strategies that can
serve more than one local jurisdiction within the region.
(3) Facilitate the development of multijurisdictional arrangements
for the marketing of recyclable materials.
(4) To the extent possible, facilitate resolution of conflicts and
inconsistencies between or among city and county source reduction
and recycling elements.
(d) The task force shall develop goals, policies, and procedures
which are consistent with guidelines and regulations adopted by the
board, to guide the development of the siting element of the
countywide integrated waste management plan.
NOTICE TO BOARD & COMMISSION APPLICANTS
REGARDING ETHICS TRAINING
On January 1, 2006, a new law became effective that requires two (2) hours of ethics
training of the local legislative bodies by January 1, 2007. This new law defines a local
legislative body as a "Brown Act" governing body, whether permanent or temporary,
decision-making or advisory, and created by formal action of the City Council. In other
words, any person serving on a City Council, Board, Commission, or Committee
created by the Council is subject to this ethics training requirement. After this initial
class, training will be required every two years.
Ethics training can be accomplished by taking a 2 -hour class, self -study, or an on-line
class. You may seek reimbursement for taking any authorized ethics class. The city
staff member that is assigned to your committee can help you with the reimbursement
process.
After you have completed the ethics class, the original certificate needs to be given to
the City Manager's Office for record-keeping, with a copy kept for your records.

Chapter 700, Statutes of 2005
This law does the following:
Ethics Training: Members of the Brown Act -covered decision-making bodies must
take two hours of ethics training every two years, if they receive compensation or
are reimbursed expenses. The training can be in-person, on-line, or self -study.
For those in office on 1/1/06, the first round of training must be completed by 1/1/07.
Expense Reimbursement -- Levels: Local agencies which reimburse expenses of
members of their legislative bodies must adopt written expense reimbursement
policies specifying the circumstances under which expenses may be reimbursed.
The policy may specify rates for meals, lodging, travel, and other expenses (or
default to the Internal Revenue Service's (IRS) guidelines). Local agency officials
must also take advantage of conference and government rates for transportation
and lodging.
• Expense Reimbursement -- Processes: Local agencies, which reimburse expenses,
must also provide expense reporting forms; when submitted, such forms must
document how the expense reporting meets the requirements of the agency's
expense reimbursement policy. Officials attending meetings at agency expense
must report briefly back to the legislative body at its next meeting.
