HomeMy WebLinkAboutCC Resolution 13855 (MSS Rates 2015)RESOLUTION NO. 13865 2KESOLUTION • THE CITY COUNCIL • THE CITY • SAN RAFAEL ESTABLISHING MAXIMUM RATES • BY MARIN SANITARY SERVICE FOR REFUSE AND RECYCLABLE MATERIAL COLLECTION AND DISPOSAL SERVICES, • BE EFFECTIVE JANUARY 1, 2015 WHEREAS, the City of San Rafael and Marin Sanitary Service have entered into a written Amendment and Restatement of Collection Agreement of the City of San Rafael and Marin Sanitary Service dated September 4, 2001; and, WHEREAS, the City of San Rafael and Marin Sanitary Service have since entered into a written Second Amendment to the Amendment and Restatement of Collection Agreement of the City of San Rafael and Marin Sanitary Service dated November 14, 2012; and, WHEREAS, Section 3 (13) of the Amendment and Restatement of Collection Agreement of the City of San Rafael and Marin Sanitary Service provides for maximum rates City Council; and, WHEREAS, Exhibit "C" of the Amendment and Restatement of Collection Agreement of the City of San Rafael and Marin Sanitary Service provides for approved rate setting tables, as amended, to be included as part of this Agreement; and, the methodology outlined under Section 3 (A) of the Amendment and Restatement of Collection Agreement of the City of San Rafael and Marin Sanitary Service; and, WHEREAS, the City of San Rafael has conducted a review of said rate application WHEREAS, the City of San Rafael has determined that such rate and fee adjustments are proper, in the best interest of all citizens, and will promote public health, safety and welfare. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: The following schedule of maximum rates and fees, attached hereto as "Exhibit C" is hereby approved to be collected by Marin Sanitary Service for refuse and recyclable material collection and disposal services, to be effective January 1, 2015. Said "Exhibit C" shall be incorporated as the revised Exhibit "C" and shall be included as part of the Second Amendment to the Amendment and Restatement of Collection Agreement of the City of San Rafael and Marin Sanitary Service dated November 14, 2012. 1, Esther C.
