RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ADOPTING A
NEGATIVE DECLARATION FOR THE SAN RAFAEL
BICYCLE/PEDESTRIAN MASTER PLAN 2011 UPDATE
WHEREAS, in October of 1998 the City Council appointed a Bicycle and Pedestrian
Committee to develop a San Rafael Bicycle and Pedestrian Plan; and
WHEREAS, in January of 1999, the Bicycle and Pedestrian Advisory Committee along with
city staff initiated preparation of a Bicycle and Pedestrian Plan; and
WHEREAS, consistent with the requirements of the City of San Rafael Environmental
Assessment Procedures Manual and the provisions of the California Environmental Quality Act
(CEQA), an Initial Study/Negative Declaration was prepared finding that the proposed San
Rafael Bicycle/Pedestrian Master Plan 2011 Update would not result in a significant
environmental impact; and
WHEREAS, the San Rafael Municipal Code Section 2.40.010 "Environmental Matters",
requires a public hearing for the Negative Declaration be held by the Planning Commission
and/or the City Council; and
WHEREAS, a notice regarding the Initial Study/Negative Declaration prepared for this project
was published in a newspaper of general circulation in the area and mailed to special interest
groups and individuals; and
WHEREAS, copies of the Initial Study/Negative Declaration were made available for a 20 day
review period by pertinent agencies and interested members of the public, commencing on
March 14, 2011 and ending on April 4, 2011; and
WHEREAS, the City Council held a public hearing on April 4, 2011 in which any and all
comments were received by interested parties.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael
does hereby adopt the Negative Declaration based on the findings that the Public Works
Department exercised its independent judgment in evaluating the Negative Declaration and the
Negative Declaration has been considered in conjunction with comments received during the
public review period. Based on this review, the Public Works Department has determined that
there is no substantial evidence that the project will have a significant impact on the
environment.
RESOLVED FURTHER, that the City Council of the City of San Rafael does hereby adopt the
Negative Declaration for the San Rafael Bicycle/Pedestrian Master Plan 2011 Update.
I, ESTHER C. BEIRNE, Clerk of the City of San Rafael, hereby certify that the foregoing
resolution was duly and regularly introduced and adopted at a regular meeting of the Council of
said City held on the 4`h day of April, 2011 by the following vote, to wit:
