RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE CITY MANAGER
TO EXECUTE AN AGREEMENT BETWEEN THE TRANSPORTATION AUTHORITY OF MARIN (TAM) AND
THE CITY OF SAN RAFAEL FOR 1-580/101 CONNECTOR PROJECT PUBLIC OUTREACH AND
RIGHT OF WAY FUNDING.
WHEREAS, the Transportation Authority of Marin entered into a Cooperative Agreement with the California
Department of Transportation (Caltrans) on November 6, 2007 for the planning, design and construction of the
Westbound 1-580 to U.S. 101 Northbound Connector Project; and
WHEREAS, the Cooperative Agreement states that TAM will act as the implementing agency for project design and
right of way phases, and further states that a Caltrans approved agency will be utilized for all right of way activities;
and
WHEREAS, the City of San Rafael will act as the Caltrans approved agency for such activities, on behalf of TAM;
and
WHEREAS, TAM and the City agrees to acquire the necessary right of way for project construction and to perform
other related tasks; and
WHEREAS, both parties further agree that execution of the 1-580/101 project will require extensive public outreach
and that such outreach will involve significant City staff time; and
WHEREAS, the parties agree that the activities described above will create a financial burden on City resources;
and
WHEREAS, TAM has agreed to reimburse the City of San Rafael for project -related right of way expenses (to a
maximum of $200,000) and public outreach expenses (to a maximum of $50,000).
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael approves the Agreement
between TAM and the City of San Rafael in the form approved by the City Attorney and on file with the City Clerk,
and authorizes the City Manager to execute said agreement.
