A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE THE CITY OF SAN
RAFAEL RESPONSE TO THE 2009-2010 MARIN COUNTY GRAND JURY REPORT
ENTITLED "THE MARIN HEALTH AND WELLNESS CAMPUS: AN INNOVATIVE
COMMITMENT TO HEALTH CARE"
WHEREAS, pursuant to Penal Code section 933, a public agency which receives a
Grand July Report addressing aspects of the public agency's operations, must comment on the
Report's findings and recommendations contained in the Report in writing within ninety (90)
days to the Presiding Judge of the Superior Court with a copy to the Foreperson of the Grand
Jury; and
WHEREAS, Penal Code section 933 specifically requires that the "governing body" of
the public agency provide said response and, in order to lawfully comply, the governing body
must consider and adopt the response at a noticed public meeting pursuant to the Brown Act; and
WHEREAS, the City Council of the City of San Rafael has received and reviewed the
2009-2010 Marin County Grand Jury Report, dated May 18, 2010, entitled "The Marin Health
and Wellness Campus: An Innovative Commitment to Health Care" and has agendized it at this
meeting for a response.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San
Rafael hereby:
1. Approves and authorizes the Mayor to execute the City of San Rafael's response
to the 2009-2010 Marin County Grand Jury Report entitled "The Marin Health and Wellness
Campus: An Innovative Commitment to Health Care" a copy of which is attached hereto as
Attachment A and incorporated herein.
2. Directs the City Clerk to forward the City's Grand Jury Report response to the
Presiding Judge of the Marin County Superior Court and to the Foreperson of the Marin County
Grand Jury.

CITY OF SAN RAFAEL RESPONSE TO THE 2009-2010 MARIN COUNTY GRAND
JURY REPORT ENTITLED "THE MARIN HEALTH AND WELLNESS CAMPUS: AN
INNOVATIVE COMMITMENT TO HEALTH CARE"
Finding F9: Inadequate signage makes finding and navigating the campus difficult
and confusing.
The City of San Rafael neither agrees nor disagrees with the finding since we have
not evaluated the signage from the perspective of a facility user. The City did not
review proposed signage since the County was not required and did not choose to
submit for sign permits from the City.
Finding F12: The newly opened market could create traffic, parking and security
challenges for the HWC. It could also provide the campus with greater exposure.
The City of San Rafael agrees with the finding. The conversion of the former
Circuit City retail store to the Mi Pueblo supermarket could alter the volume and
timing of vehicular and pedestrian traffic to the site. The location of a full service
market has been a long-standing desire of the Canal neighborhood, and will reduce
overall traffic from the neighborhood to existing grocery stores outside the
immediate area. The City's Traffic Engineer notes that the volume of traffic to the
store has already declined since its opening, but has confirmed the need for physical
improvements to address concerns over pedestrian safety. A new pedestrian/bicycle
crosswalk will be installed across Bellam Boulevard within the next month.
The operators of Mi Pueblo Market provide on-site security, and the Police
Department has not noted an increase in crime either on-site or in the vicinity
associated with the new market.
Recommendation Rl: Signs directing clients to the HWC, as well as the signage on
the campus, be improved to help clients navigate to and around the campus.
The City of San Rafael does not have responsibility or jurisdiction for designing,
installing or regulating signage for the HWC. As noted above, the County is not
required to comply with City regulations or permit procedures for its facilities, and
has exempted itself from these processes for the Health and Wellness Center. If the
County wishes to install additional signage in the public right-of-way, we would
suggest consultation with the City Traffic Engineer to assure adequate and safe
visibility within the public right-of-way.
