RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL OPPOSING
PROPOSITION 23, "SUSPENDS IMPLEMENTATION OF AIR POLLUTION
CONTROL LAW (AB 32) REQUIRING MAJOR SOURCES OF EMISSIONS TO
REPORT AND REDUCE GREENHOUSE GAS EMISSIONS THAT CAUSE GLOBAL
WARMING UNTIL UNEMPLOYMENT DROPS TO 5.5 PERCENT OR LESS FOR
FULL YEAR" ON NOVEMBER 2010 BALLOT
WHEREAS, Proposition 23 has qualified for the November 2010 statewide
ballot; and
WHEREAS, Proposition 23 would suspend the implementation of the AB 32, the Global
Warming Solutions Act of 2006 requiring California to develop regulations that will reduce
greenhouse gas emissions to 1990 levels by 2020; and
WHEREAS, in 2006 the City of San Rafael was one of the initial signatories of the U.S.
Mayors Climate Protection Agreement; and
WHEREAS, on April 20, 2009, the City of San Rafael approved a Climate Change Action
Plan; and
WHEREAS, on January 19, 2010, the City of San Rafael approved a Green Building
Ordinance; and
WHEREAS, the City of San Rafael is a member of the Marin Energy Authority ("MEA");
and
WHEREAS, Marin County has been on the forefront of investing in green initiatives
including Marin Energy Authority to provide a renewable energy alternative to local residents and
businesses and the Marin Green Building Energy Retrofit and Solar Transformation (BERST)
program. The BERST program has already been adopted by the County and three of the eleven cities
and towns, with the others anticipated to follow within the next year; and
WHEREAS, suspending AB 32 would negatively impact the actions that the City of San
Rafael and the County of Marin have taken to address climate change; and

WHEREAS, suspending AB 32 would negatively impact California's emerging clean
energy industry that is creating jobs throughout the State including in Marin County; and
WHEREAS, the County of Marin, the Marin Municipal Water District, the Town of
Fairfax and Assemblymember Huffman have opposed this Proposition.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council hereby joins
with other cities and government entities throughout the State in opposing Proposition 23.
BE IT FURTHER RESOLVED that the San Rafael City Council hereby directs staff to notify the
League of California Cities regarding this action.
