RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING A NOISE
ORDINANCE EXCEPTION TO THE SOUND PERFORMANCE TIME LIMITS AND A
PERMIT TO ALLOW ANDY'S MARKET TO HOLD A ONE -DAY FESTIVAL AND MUSIC
CONCERT ON SATURDAY, OCTOBER 2, 2010, AT 688 POINT SAN PEDRO ROAD

WHEREAS, on July 20, 2010, Mark Piersante (representing Andy's Market) submitted
an application seeking approval of a permit to allow a daytime festival and nighttime music
concert to be held on the Loch Lomond Marina property at 688 Point San Pedro Road on October
2, 2010 from 10:00 am to 11:30 pm; and
WHEREAS, consistent with the requirements of Chapter 10.44.080 of the San Rafael
Municipal Code, the City Council reviewed the applicant's Claim for Waiver Deposit (requesting
to waive the required $500 deposit to ensure that the property where the carnival is held is left in
a neat, clean, healthy and sanitary condition pursuant to SRMC Section 10.44.030); and
WHEREAS, a courtesy notice of the City Council meeting was sent to neighboring
property owners and occupants within 600 feet of the subject property on September 3, 2010; and
WHEREAS, on September 20, 2010, the City Council considered the proposed carnival
pen -nit accepting all public comment and the written report of the Department of Community
Development.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Rafael does hereby approve a carnival permit for Andy's Market to allow a daytime festival from
10:00 am to 4:00 pm and a music concert to be held from 6:00 pm to 11:30 pm on Saturday,
October 2, 2010, as described in "Exhibit A", and does hereby also approve the applicant's Claim
for Waiver Deposit, subject to the following conditions of approval:
Parking areas shall be marked and reserved for marina berth tenants and "live -aboard"
residents and for marina boat launch day users. Bicycle parking shall be provided for the
daytime festival. The applicant shall contact BPAC (Bicycle and Pedestrian Advisory
Committee) to discuss plans for bicycle parking.
2. The applicant shall coordinate with the City Traffic Engineer to place "No Parking" signs on
the north side of Pt. San Pedro Road, between Lochinvar Road and Bayview Drive.
3. Applicant shall post "No Parking — Tow Away" signs in the narrow portion of the eastern
jetty. Parking is allowed only in the areas striped for parking in the northern and southern
end of the jetty.
4. Upon owner approval, applicant will make available 150 on-site parking spaces (east of the
traffic light) available for event parking.
An "Event Manager" shall be designated to inventory parking on-site. Once parking reaches
95% of capacity (489 vehicles), volunteers would direct cars to park at the San Pedro
Elementary School parking lot. The Event Manager would post 4 "Event Parking" signs west
of Manderly Road directing cars to the event parking area at San Pedro School.
6. There shall be a minimum of 10 volunteers assigned to direct evening traffic, and they shall
be equipped with reflective vests and flashlights to maximize safety.
7. Prior to the commencement of the carnival, or no later than Friday, October 1, 2010, the
applicant shall submit to the Planning Division a copy of all required permits and approvals
that have been obtained (i.e., Fire Department, Health Department, Alcoholic Beverage
Control, etc).
8. No music shall be played after 11:00 pm
9. All clean-up activities shall be completed by 11:30 on Saturday, October 2, 2010. The tent
shall be removed on Sunday, October 3, 2010.
10. All clean-up of windblown debris on the north side of Point San Pedro Road and the north
side of Andy's Market shall be completed by Sunday, October 3, 2010. The applicant shall
inspect the site on two consecutive days following the event to ensure that all debris has been
removed.
11. Applicant shall coordinate with Sergeant Christopher Coale, SRPD (485-3034) to arrange for
officers to be present on site during the daytime and evening events.

Resolution was duly and regularly introduced and adopted at a regular meeting of the City
Council of the City of San Rafael, held on Monday the 20`x' day of September 2010, by the
