A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL APPOINTING
STANDBY OFFICERS FOR EACH MEMBER OF THE SAN RAFAEL CITY COUNCIL.
WHEREAS, a continuity of Government Section is included in the City of San Rafael
Emergency Operations plan; and
WHEREAS, the function and continuity of the San Rafael City Council is important during
periods of a disaster or other emergencies: and
WHEREAS, when members of the San Rafael City Council are unavailable, alternates
have been identified; and

WHEREAS, Section 8638, Article 15, Chapter 7, Division 1, Title 2 of the California
Government Code, Preservation of Local Government, authorizes the San Rafael City Council
to appoint named individuals, in order of selection, as standby officers for each member of the
City Council; and
WHEREAS, each City Council member has identified two alternates, in order of selection,
as standby officers for their position; and
WHEREAS, the standby officers will provide the City of San Rafael a continuity of
government if elected officials are unavailable during an emergency.
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
To Appoint the San Rafael Residents identified by City Council Members as Standby Officers for
each City Council position.

Resolution was duly and regularly introduced and adopted at a reqular meeting of the City
Council of said City held on Mondav, the 5th day of Januarv. 2009 by the following vote, to wit:

SUBJECT: ADOPT RESOLTUTION APPROVING STANDBY CITY COUNCIL
MEMBERS.
RECOMMENDATION: Adopt Resolution.
BACKGROUND:
The ability of the City of San Rafael City Council to fulfill its obligations can be severely
impacted during an emergency if members are unavailable (missing, deceased, unable
to function). This resolution allows the City Council to approve a line of succession for
City Council members.
Section 8638, Article 15, Chapter 7, Division 1, Title 2 of the California Government
Code, Preservation of Local Government, authorizes the San Rafael City Council to
appoint named individuals, in order of selection, as standby officers for each member of
the City Council. Each City Council member has been asked to identify individuals that
could fulfill their elected obligations if they are otherwise unable to. The Standby City
Council members would be used during an emergency when the City Council can not
reconstitute itself and its members are unavailable.
Standby City Council members have the duty to
• Keep informed of the business and affairs of the City to the extent necessary to
be able to fill their post, and attend any information meetings arranged by the
City for that purpose.
• Report for duty in the event of an emergency at the place and in the method
designated by the City as presented to them during training.
• Fill the post for which appointed when the reqular officer is unavailable durina a
state of war emergencv, state of emergencv, or local emerqencv. The standby

officers are designated in order of succession, as outlined in the Government
Code.
ANALYSIS:
While filling the post of an unavailable regular City Council member durinci the
emerciencv, the Standby City Council member would assume all the other duties and
responsibilities that the regular City Council member would have had, including the duty
to attend council meetings, vote on matters brought before the City Council, comply with
the Fair Political Practices Act with respect to avoidance of conflicts of interest in
making decisions, and comply with the Ralph M. Brown Act public meeting law.
Standby City Council members must take an oath of office upon appointment and will
serve in those positions until removed or replaced by the City Council, or until they
resign from that position. Standby members are designated in the attached resolution.
Standby City Council members will participate in required emergency services training
(2 hours) as required by State & Federal law and remain familiar with San Rafael's
disaster operations.
Standby City Council members must file conflict of interest statements (Form 700's) with
the City Clerk in the same manner as City Council members, per 2 CCR Section
18722(c). ("alternate" or "designee" of persons holding office specified in Government
Code Section 87200, must disclose economic interest "in the same manner as the
person holding the office".)
FISCAL IMPACT:
The action of approving the draft Standby City Council members has no fiscal impact.
OPTIONS:
1. Approve the Standby City Council members or approve with modifications.
2. Do not approve the Standby City Council members and direct staff to make
changes.
ACTION REQUIRED:
Adopt Resolution as presented.
