RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
APPROVING THE DEDICATION OF 2,480 SQUARE FEET OF CITY OWNED
PROPERTY FROM ASSESSOR'S PARCEL NUMBER 014-101-07 TO THE
PUBLIC RIGHT-OF-WAY, AND AUTHORIZING THE CITY MANAGER AND
CITY CLERK TO EXECUTE AND RECORD ANY DOCUMENTS THAT MAY
BE REQUIRED TO EFFECTUATE SUCH DEDICATION.
WHEREAS, based on routine traffic monitoring and review of citizens'
request by the Traffic Coordinating Committee, it was recommended that the intersection
of Third Street and Union Street be improved based on traffic engineering design and
professional judgment; and
WHEREAS, the design of the improvements includes, among others,
installation of a westbound right turn lane at the intersection and widening of the sidewalk
along Third Street; and
WHEREAS, 2,480 square feet of the proposed project is located outside of
public right-of-way and on the City owned property at 210 Third Street (Assessor's Parcel
Number 014-101-07); and
WHEREAS, the proposed project is intended for use by the public; and
WHEREAS, a legal description and plat map to accompany the legal
description has been prepared and stamped by a liscenced Land Surveyor for the
dedication of the land; and
WHEREAS, the 2,480 square feet of land dedication will encompass the
entirety of the proposed project intended for public use.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of San Rafael that the Council does hereby approve the dedication of 2,480 square
feet from the City owned property at 210 Third Street (Assessor's Parcel Number 014-
101-07) to the public right-of-way as described and depicted on attached Exhibit A, and
authorizes the City Manager and City Clerk to record any documents that may be required
to effectuate such dedication.

foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the
Council of said City on the 201h day of April, 2009, by the following vote, to wit:

Legal Description
Third Street Right -of -Way Dedication
All that certain real property situate in the City of San Rafael, County of Marin, State of
California described as follows:
Beginning at the southwest corner of Parcel 1 as described in deed to the San Rafael High
School District filed for record in Book 438 of Official Records at Page 102 in the office
of the Marin County Recorder, said point being further described therein as the
intersection of the northerly line of Third Street with the easterly line of Union Street,
each as they then existed; thence along said northerly line North 63°00'07" West, 93.57
feet to the southerly projection of the easterly line of Union Street (60 feet wide) as it
now exists, thence along last said easterly line North 17° 11'40" East, 42.24 feet; thence
leaving said easterly line South 22'54'13" East, 25.78 feet to a point 25 feet northerly of,
when measured at a right angle thereto, said northerly line of Third Street, thence parallel
with said northerly line, South 63°00'07" East, 76.72 feet to the former easterly line of
said Union Street, thence South 1711'36" West, 25.37 feet to the Point of beginning.
Containing 2,480 square feet, more or less.
Bearings used in this description are based upon the California Coordinate System (NAD
27) Zone 3.
