RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
APPROVING THE PURCHASE OF TWO PARKING ENFORCEMENT
VEHICLES THROUGH A SOLE SOURCE AGREEMENT FROM
MUNICIPAL MAINTENANCE EQUIPMENT COMPANY IN THE AMOUNT
OF $56,440.00.
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES AS FOLLOWS:
WHEREAS, two parking enforcement vehicles have exceeded their useful life
expectancy; and,
WHEREAS, the Parking Enterprise Fund has set aside funds in the City's
Vehicle Replacement Fund to purchase two new parking enforcement vehicles; and,
WHEREAS, the Parking Services Division has researched all possible
manufacturers of parking enforcement vehicles; and,
WHEREAS, the only gasoline powered, three -wheeled, right -side drive parking
enforcement vehicle available is the GO -4 marketed by Municipal Maintenance
Equipment Company;
WHEREAS, under section 2.55.070 of the San Rafael Municipal Code, in those
circumstances where limitations on the source of supply, necessary restrictions in
specifications, necessary standardization, quality considerations or other valid reasons
exist, the City can award purchase contracts without recourse to the competitive bidding
procedure; and
WHEREAS, there is only one manufacturer of parking enforcement vehicles that
can provide a vehicle with the specifications required by the San Rafael Parking
Division as detailed in the staff report, incorporated herein by reference;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
RESOLVES AS FOLLWS:
1. All of the facts recited above are true and correct.
2. The Council finds that necessary restrictions in specifications, quality
considerations and other valid considerations justify awarding this purchase agreement

without recourse to the bidding procedures of section 2.55.070 of the San Rafael
Municipal Code.
2. Municipal Maintenance Equipment Company is hereby awarded a contract for
the one time purchase of two (2) GO -4 parking enforcement vehicles in the amount of
$56,440.00.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the
foregoing Resolution was duly and regularly introduced and adopted at a regular
meeting of the City Council of said City held on 20th day of February, 2007 by the
following vote, to wit:
