A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE THE CITY
OF SAN RAFAEL REPSONSE TO THE 2005-2006 MARIN COUNTY GRAND
JURY REPORT ENTITLED "THE NEXT DISASTER: ARE MARIN CITIZENS
PREPARED?"
WHEREAS, pursuant to Penal Code Section 933, a public agency which receives a Grand Jury
Report addressing aspects of the public agency's operations, must comment on the Report's
findings and recommendations contained in the Report in writing to the Presiding Judge of the
Superior Court within (90) days; and
WHEREAS, Penal Code section 933 specifically requires that the "governing body" of the
public agency provide said response and, in order to lawfully comply, the governing body must
consider and adopt the response at a noticed public meeting pursuant to the Brown Act; and
WHEREAS, The City Council of the City of San Rafael has received and reviewed the 2005-
2006 Marin County Grand Jury Report, dated May 26, 2006, entitled "The Next Disaster: Are
Marin Citizens Prepared?" and has agendized it at this meeting for a response.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael
hereby:
Approves and authorizes the Mayor to execute the City of San Rafael's response
to the 2005-2006 Marin County Grand Jury Report entitled "The Next Disaster:
Are Marin County Citizen's Prepared?", copy attached and incorporated herein.
2. Directs the City Clerk to forward the City Council's Grand Jury Report response
to the Marin County Superior Court and to the Foreperson of the Marin County
Grand Jury.

SUBJECT: City of San Rafael's Response to 2005-2006 Marin Grand Jury Report Entitled:
"The Next Disaster: Are Marin Citizens Prepared?"
RECOMMENDATION: Adopt Resolution Approving and Authorizing the Mayor to sign the
City of San Rafael response to the Grant Jury Report entitled "The Next Disaster: Are Marin
Citizens Prepared?"
BACKGROUND: In the Marin Grand Jury report June 20, 2006, entitled "The Next Disaster: Are
Marin Citizens Prepared?" several findings and recommendations were made. By law we are
required to submit a formal response on the findings and recommendations of the Grand Jury Report.
The Grand Jury made the follow findings and recommendations for response by the Cities and Towns
in Marin County:
Grand Jury Findines:
Fl. "There is widespread agreement among government officials and concerned citizens
that there is a pervasive public apathy with regard to citizen disaster preparedness in
Marin County."
F4. "Motivating our citizens to prepare for disaster requires sustained and persuasive
reminders of the inevitability of disasters in Marin."
F5. "Three County entities have been providing considerable leadership and support to
county -wide efforts to get the citizens to prepare for disasters and are in positions to
provide additional leadership and support."
IF6. "Local disaster councils, disaster preparedness committees, and local neighborhood
organizations represent sound community approaches to getting citizens to prepare;

however, some cities and towns do not have active disaster councils, disaster
preparedness committees, or their equivalent."
Grand Jury Recommendations:
R2. "That the County Office of Emergency Services expand its Disaster Service Worker
(DSW) database to include the results of citizen preparedness certification programs
conducted by local disaster councils, disaster preparedness committees, and
neighborhood organizations and periodically publish statistical information as an
informal gauge of the level of preparedness to keep this issue in the public eye."
R3. "That the Marin Operational Area Disaster and Citizens Corps Council dedicate a
forum, perhaps Public Disaster Education & Preparedness Committee (PDEP) for
community disaster preparedness organizations (such as local disaster councils,
disaster preparedness committees, homeowner associations, neighborhood
organizations, and individual citizens) to come together on a regular basis to share
ideas and coordinate programs to get citizens to prepare for disasters."
R4. "That the Office of Emergency Services institute on-going campaigns to remind the
citizens of the inevitability of disasters and the need to prepare for them (e.g. Marin
Disaster Preparedness Week)."
R5 "That each City and Town in Marin County establish and maintain a disaster council
that actively engages in getting its citizens to prepare for disasters; that these disaster
councils, disaster preparedness committees or their equivalent and any local
neighborhood organizations develop and implement certification programs that will
motivate and recognize citizen disaster preparedness; and that they report the results
of their programs to OES for incorporation into its database."
ANALYSIS: As required by California Penal Code Section 933, the staff has drafted the following
responses to the above -stated Grand Jury findings and recommendations.
The City of San Rafael AGREES WITH Grand Jury FINDINGS Fl, F4, F5. F6.
2. The City of San Rafael states that, with regard to the City of San Rafael,
RECOMMENDATION R2 HAS BEEN IMPLEMENTED, and the City of San
Rafael will continue to provide DSW volunteer registration to the County of Marin for
inclusion in its DSW database.
3. The City of San Rafael states that, with regard to the City of San Rafael,
RECOMMENDATION R3 HAS NOT BEEN IMPLEMENTED, however the City
will participate in the September 14"' meeting of the Disaster & Citizen Corps Council
sponsored by the County of Marin Office of Emergency Services .
4. The City of San Rafael states that, with regard to the City of San Rafael,
RECOMMENDATION R4, HAS BEEN IMPLEMENTED. The City of San
Rafael does actively promote an on-going campaign of citizen awareness, and
conducts classes for citizens in area of emergency preparedness. The City of San
Rafael has a full-time Emergency Services Coordinator position to further this goal.

The City is actively conducting outreach to citizens groups and neighborhood
associations in order to further the public's knowledge about the steps that can be
taken to improve their own levels of preparedness. In addition, the City has an
ongoing Citizens Emergency Response Team program (DART) that conducts training
at least four times a year in community preparedness and response. CERT/DART
instructors also conduct basic neighborhood preparedness presentations for groups and
associations within the City.
5. The City of San Rafael states that, with regard to the City of San Rafael,
RECOMMENDATION R5, HAS BEEN IMPLEMENTED, and that a City of San
Rafael Disaster Council has been in existence since 1973. The Disaster Council is
being revitalized and a meeting is being scheduled before September 30, 2006.
Expansion of the Disaster Council is being studied by staff to include representatives
from the American Red Cross and the Salvation Army. The City of San Rafael also
has a functioning internal Disaster Preparedness Committee that has been meeting on
a monthly basis. The City of San Rafael will provide information on City programs to
the Marin County Office of Emergency Services on a regular basis.
FISCAL IMPACT: None
OPTIONS: 1) Adopt the Resolution
2) Reject the Resolution
3) Send back for additional study
ACTION REQUIRED: Staff recommends that the City Council adopt the Resolution that approves
and authorizes the Mayor to execute the City of San Rafael's response to the 2005-06 Marin Grand
Jury Report entitled "The Next Disaster: Are Marin Citizens Prepared?"
