RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING A PERMIT TO
ALLOW ST. ISABELLA'S SCHOOL TO HOLD A CARNIVAL FROM OCTOBER 6, 2006
TO OCTOBER 8, 2006, AT ONE TRINITY WAY (APNs: 175-181-25 AND 27)
(ST. ISABELLA PARISH PROPERTY)
WHEREAS, on June 29, 2006, the St. Isabella School Carnival Committee submitted a
letter seeking approval of a permit to allow a carnival to be held on the St. Isabella Parish
property at One Trinity Way from October 6, 2006 to October 8, 2006; and
WHEREAS, consistent with the requirements of Chapter 10.44.080, the City Council
reviewed and approved the applicant's Claim for Waiver Deposit thereby waiving the required
$500 deposit to ensure that the property where the carnival is held is left in a neat, clean, healthy
and sanitary condition pursuant to SRMC Section 10.44.030; and
WHEREAS, a courtesy notice of the City Council meeting was sent to neighboring
property owners and occupants within 300 feet of the subject property on September 1, 2006; and
WHEREAS, on September 18, 2006, the City Council considered the proposed carnival
permit accepting all public comment and the written report of the Department of Community
Development.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Rafael does hereby approve a carnival permit for St. Isabella School to allow a carnival to be held
from October 6, 2006 to October 8, 2006, as described in letter from James Woolwine, dated June
29, 2006, attached as Exhibit "A," subject to the following conditions of approval:
1. No carnival games or rides shall be located within 50 feet of the rear yard fences of homes on
Las Pavadas Avenue and Arias Street.
2. The portable restrooms shall be located between the main school building and the science
laboratory. The Community Development Director may approve alternate locations for the
restrooms, provided that they are placed towards the middle of the project site, and it can be
demonstrated that the location would comply with the Fire Department's requirements for
access and fire lanes, and the Health Department's requirements for distance from food
preparation and service areas.
3. Prior to the commencement of the carnival, a site plan showing the location of carnival games
and rides shall be submitted to the Community Development Department for review and
approval. The applicant shall also demonstrate that all required permits and approvals have
been obtained (i.e., Fire Department, Health Department, Alcoholic Beverage Control, etc).
4. Set up and tear down of the carnival shall not occur past 9:30 p.m.

Resolution was duly and regularly introduced and adopted at a regular meeting of the City
Council of the City of San Rafael, held on Monday the 18'' day of September 2006, by the
following vote, to wit:

I am seeking council approval to hold the fifth annual Saint Isabella Carnival, October 6
— 8, 2006. The planned hours of operation are 3:00 PM to 10:00 PM Friday, October 6,
10:00 AM to 10:00 PM Saturday October 7, and 10:00 AM to 6:00 PM Sunday, October
8.
This event is held completely on the private property of Saint Isabella. As in years past,
we will be providing ample off-street parking for all event goers and professional
security.
The carnival will include rides from Butler Amusements, games, astro jumps, food, beer,
and wine. We will again be having community service and outreach attractions. Last
year we had representatives from the Fire Department and the Marin Humane Society.
We hope they will join us again this year. We are also hoping to have representatives
from the Marin County Sheriff and Marin Search and Rescue.
We have received tremendous positive feedback about our carnival from our Terra Linda
neighbors. They enjoy being able to walk to a safe, fun, family event in their own
neighborhood. While we enjoy a modest financial success from the carnival, the real
value it provides is in bringing the community together.
We would like the $500 fee waived, since this carnival is held on private grounds and we
have historically kept the grounds neat, clean, healthy, and in sanitary conditions before,
during and after the carnival. (10.44.080 Claim for waiver of deposit)
