A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL AUTHORIZING THE PURCHASE OF STATE
HOMELAND SECURITY AND DOMESTIC PREPAREDNESS
SUPPLIES AND EQUIPMENT, AND APPROVING WAIVER
OF COMPETITIVE BIDDING FOR SUCH PURCHASES.
WHEREAS, the U.S. Department of Homeland Security has awarded funds to the State of
California to enhance the capabilities of our state and local first responders in responding to
incidents involving weapons of mass destruction and terrorism; and
WHEREAS, the Homeland Security funds can be used for the purchase of equipment,
training, planning, and exercises for first responders ("first responder equipment"); and
WHEREAS, the County of Marin Office of Emergency Services has received Homeland
Security grant funds from the State of California under the State [ lomeland Security and Domestic
Preparedness Grant Program, and has designated the City of San Rafael as a purchasing agent for the
purchase of first responder equipment in the amount of $514,450.70 for certain local first responder
agencies within the County, subject to reimbursement from the Marin County Office of Emergency
Services; and
WHEREAS, the City of San Rafael is the host for the County of Marin Hazardous Materials
Emergency Response Team JPA and the City of San Rafael Urban Search and Rescue Team
(US&R); and
WHEREAS, the state of California has 45 days to distribute eighty percent of these funds to
their cities and counties, and the City of San Rafael must follow very restrictive guidelines which
prevent the use of the City's competitive bidding process; and
WHEREAS, the State Homeland Security and Domestic Preparedness Grant Program
equipment purchase list for first responder equipment was derived from the federal Standardized
Equipment List, compiled to delineate the types of equipment necessary for weapons of mass
destruction or terrorist incident response and for equipment standardization and interoperability; and
WHEREAS, the City Council is authorized to waive competitive bidding pursuant to San
Rafael Municipal Code Section 2.55.070(D) in the case of necessary restrictions in specifications,
necessary standardization, quality considerations, or other valid reasons, and
WHEREAS, the City Council of the City of San Rafael hereby finds: 1) that the purchase of
this vital first responder equipment will benefit the public and protect first responders, 2) that the
purchase of this equipment is limited to the federally approved standard equipment list and is
consistent with County of Marin standard equipment purchases, 3) that a waiver of the formal
bidding process is required because of extreme time constraints required to participate in the grant

process, and 4) that the purchase of this equipment and the waiver is necessary to the City's mission
to continue to provide emergency services to its citizens;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Rafael hereby affirms and declares:
1) That all of the facts recited above are true and correct.
2) That the City Council authorizes the Management Services Director to execute,
purchase order contracts for the first responder equipment under the State Homeland
Security and Domestic Preparedness Grant Program, as such equipment is designated for
purchase by the City on the County of Marin Office of Emergency Services approved list
provided to the City, in a total amount not exceeding $550,000.
3) That the City Council approves the waiver of the competitive bidding process for these
first responder equipment purchases.
