A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL ADOPTING A NEGATIVE DECLARATION FOR
THE SAN RAFAEL BICYCLE AND PEDESTRIAN PLAN
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES AS FOLLOWS:
WHEREAS, in January 1999 the Bicycle and Pedestrian Advisory Committee and City of
San Rafael initiated preparation of the San Rafael Bicycle and Pedestrian Plan ("PROJECT"
herein); and
WHEREAS, consistent with the requirements of the City of San Rafael Environmental
Assessment Procedures Manual and the provisions of the California Environmental Quality Act
(CEQA), an Initial Study/Negative Declaration was prepared finding that the proposed Bicycle and
Pedestrian Plan would not result in any significant environmental impact; and
WHEREAS, a notice of intent to adopt the Initial Study/Negative Declaration was prepared
for this PROJECT, was published in a newspaper of general circulation in the area, was mailed to
special interest groups and individuals, and was posted in the Marin County Clerk's Office; and
WHEREAS, copies of the Initial Study/Negative Declaration were made available for a 20
day review period by pertinent agencies and interested members of the public, commencing on
November 21, 2001; and
WHEREAS, on December 11, 2001, the Planning Commission held a public hearing on
the proposed initial Study/Negative Declaration, and after accepting public testimony and the
written report of the Department of Public Works, the Planning Commission approved a resolution
recommending that the City Council approve and adopt the Initial Study/Negative Declaration.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of San Rafael
does hereby adopt the Negative Declaration based on the findings that:
1) The Planning Commission, exercising its independent judgment, has evaluated the
Initial Study/Negative Declaration at a noticed meeting and, after receiving comments
and testimony recommended that the City Council approve the Initial Study/Negative
Declaration; and
2) All due public notices required by law have been given regarding the Initial
Study/Negative Declaration; and
3) The Initial Study/Negative Declaration was circulated for twenty (20) days to receive
public comment; and

4) The City Council has received and considered any and all comments received during the
public comment period, the hearing before the Planning Commission, and the hearing
before the City Council; and
5) Upon review and consideration of all relevant information, the City Council specifically
finds that there is no substantial evidence that the PROJECT will have any significant
impact on the environment.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the
foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the San
Rafael City Council held on the 4`" day of February, 2002, by the following vote, to wit:
AYES: Councilmembers: Cohen, Heller, Miller, Phillips and Mayor Boro
