RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
ACCEPTING GRANT DEED FROM OLYMPIA INVESTMENT INC. AND
AUTHORIZING THE EXPENDITURE OF $38,480.00 TO BE FUNDED FROM THE
NORTH SAN RAFAEL TRAFFIC MITIGATION FEE FUND
(PORTION OF APN: 179-142-04, PROPERTY ADDRESS 127 MERRYDALE ROAD)
WHEREAS, the San Rafael Planning Commission on October 5, 1999, approved a
tentative map for eight residential condominium units on 127 Merrydale Road; and
WHEREAS, the condition of approval for the map required that the developer dedicate
a portion of land fronting Merrydale Road for right of way purposes; and
WHEREAS, David Tattersall & Co., a certified property appraiser from San Rafael, was
engaged to appraise the value of the right of way, and, in his appraisal report dated August 24,
2000, valued the right of way to be $38,480.00; and
WHEREAS, Olympia Investment Inc. has agreed to the appraised cost of the right of
way acquisition; and
WHEREAS, public interest, convenience and welfare require that the property
hereinafter mentioned be purchased and used for the benefit of the public of the City of San
Rafael, California.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
San Rafael, California, that that certain grant deed, executed by Olympia Investment Inc., to the
City of San Rafael, dated January 4, 2002, be and the same is hereby accepted and the Clerk of
said City is hereby directed to cause said conveyance to be duly recorded in the office of the
County Recorder of the County of Marin, State of California, forthwith upon the adoption of this
resolution.

BE IT FURTHER RESOLVED that the sum of $38,480.00 is authorized for this
expenditure from the North San Rafael Traffic Mitigation Fee fund, said amount to be paid upon
recordation of the grant deed.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, California, hereby certify
that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting
of the Council of said City held on the 4"' day of March, 2002, by the following vote, to wit:

BEGINNING at a point on the Southwesterly right of way line of the Old County Road leading from San Rafael to Petaluma,
distant thereon North 32° 34' 30" West, 75 feet from the most Northerly corner of the parcel conveyed by John Brazil, et ux,
to John Timmer, et ux, by Deed recorded June 26, 1947 in Book 555 of Official Records at page 156, Marin County Records;
