RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ADOPTING A NEGATIVE
DECLARATION FOR A 400 -SPACE PUBLIC PARKING STRUCTURE AT 900 C STREET
(APN 011-255-06, 07, 09, 10, 13, 14, 15, 18 and part of 26)
WHEREAS, on December 6, 2001, applications for a General Plan Amendment (GPA01-02) to
add a provision for an 18 -foot height bonus to a portion of the Second/Third Mixed Use West District for
public parking, a Zone Change (ZC01-08) to add a provision for an 18 -foot height bonus for public
parking to a portion of the Second/Third Mixed Use West District, a Use Permit (UP01-61) and an
Environmental and Design Review Permit (ED01-144) to allow the granting of a height bonus and
construction of a 400 -space public parking structure were submitted, and were subsequently deemed
complete for processing on January 2, 2002; and
WHEREAS, consistent with the requirements of the City of San Rafael Environmental
Assessment Procedures and the provisions of the California Environmental Quality Act (CEQA), an
Initial Study was prepared, finding that the proposed project would not result in significant
environmental effects; and
WHEREAS, pursuant to California Government Code Section 15105(b), notices regarding the
Initial Study and the project applications were: a) published in a local newspaper of general circulation in
the area; b) provided to the County Clerk; and c) mailed to surrounding property owners within 300 feet,
appropriate agencies, organizations, and special interest groups; and
WHEREAS, copies of the Initial Study/Negative Declaration were made available for a 20 -day
review period by pertinent agencies and interested members of the public, commencing on March 20,
2002; and
WHEREAS, the custodian of documents which constitute the record of proceedings upon which
this decision is based is the Community Development Department; and
WHEREAS, on April 9, 2002, the Planning Commission recommended that the City Council
adopt the proposed Negative Declaration; and
WHEREAS, on May 6, 2002, the City Council held a public hearing on the proposed Initial
Study/Negative Declaration and accepted public testimony and the written report of the Community
Development Department.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael
does hereby adopt the proposed Negative Declaration based on the following findings:
1. The City Council exercised its independent judgement in evaluating the Negative
Declaration and the Negative Declaration has been considered in conjunction with comments
received during the public review period and at the City Council hearing.
2. Based on this review, the City Council has determined that there is no substantial evidence
that the project will have a significant impact on the environment.

foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council
of said City held on the 6th day of May 2002, by the following vote:
