LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1844 entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING VARIOUS SECTIONS OF THE SAN RAFAEL MUNICIPAL CODE TO REMOVE REFERENCES TO THE FIRE MARSHAL, DEPUTY FIRE MARSHAL, AND FIRE PREVENTION BUREAU INSPECTORS, TO BE CONSISTENT WITH THE RECENT AMENDMENTS OF CHAPTERS 4.04 AND 4.08 OF THE SAN RAFAEL MUNICIPAL CODE IN CONNECTION WITH THE FIRE DEPARTMENT PHASE II REORGANIZATION" is a true and correct copy of an Ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the 20th day of November, 2006, published as required by City Charter in the MARIN INDEPENDENT JOURNAL, a newspaper published in the City of San Rafael, and passed and adopted as an Ordinance of said City at a REGULAR meeting of the City Council of said City held on the 4th day of December, 2006, by the following vote, to wit: AYES: COUNCILMEMBERS: Cohen, Heller, Miller, Phillips and Mayor Boro NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None WITNESS my hand and the official seal of the City of San Rafael this 5th day of December, 2006 A.- J M. LEONL�INI, City Clerk ORDINANCE NO. 1844 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING VARIOUS SECTIONS OF THE SAN RAFAEL MUNICIPAL CODE TO REMOVE REFERENCES TO THE FIRE MARSHAL, DEPUTY FIRE MARSHAL, AND FIRE PREVENTION BUREAU INSPECTORS, TO BE CONSISTENT WITH THE RECENT AMENDMENTS OF CHAPTERS 4.04 AND 4.08 OF THE SAN RAFAEL MUNICIPAL CODE IN CONNECTION WITH THE FIRE DEPARTMENT PHASE II REORGANIZATION. WHEREAS, the City Council by Resolution No. 12145 and by Ordinance No. 1843, amending Chapter 4.04 and 4.08 of the San Rafael Municipal Code, have transferred the fire prevention functions previously assigned to the Fire Marshal, Deputy Fire Marshal, and fire prevention bureau inspectors in the Fire Department to the Chief Building Official, and WHEREAS, there remain various references in the San Rafael Municipal Code that contain obsolete references to the Fire Marshal, Deputy Fire Marshal, and fire prevention bureau inspectors that need to be revised; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS: DIVISION 1: Section 1.08.020 of the San Rafael Municipal Code is amended to delete the references to "fire marshal", "deputy fire marshal", and "fire prevention bureau inspectors" in the definition of "Code enforcement official." Section 8.20.080 of the San Rafael Municipal Code is amended to substitute "fire chief' for "fire marshal" where the latter term appears in that section. Section 9.30.030(B)((1) of the San Rafael Municipal Code is amended to delete the references to "fire marshal" and "fire prevention bureau inspectors", and to substitute "designated as code enforcement officials in Section 1.08.020" for "designated in Chapter 2.36" in that section. Section 10.04.200 of the San Rafael Municipal Code is amended to delete the reference to "the fire marshal" in that section. Section 15.06.050(f) of the San Rafael Municipal Code is amended to substitute "fire chief' for "fire marshal" where the latter term appears in that section. Section 15.06.120 of the San Rafael Municipal Code is amended to substitute "chief building official" for "fire marshal" wherever the latter term appears in that section. Section 15.11.100(g) of the San Rafael Municipal Code is amended to substitute "fire chief' for "fire marshal" wherever the latter term appears in that section. Section 15.12.080(i)(2) of the San Rafael Municipal Code is amended to substitute "chief building official" for "fire marshal" wherever the latter term appears in that section. DIVISION 2: This ordinance is exempt from the California Environmental Quality Act ("CEQA") pursuant to the State CEQA Guidelines, since the Ordinance relates to a local government reorganization (14 Cal. Code Regs. Section 15320), and it can be seen with certainty that there is no possibility that this ordinance or its implementation would have a significant effect on the environment (14 Cal. Code Regs. Section 15061(b)(3)). DIVISION 3: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. 2 DIVISION 4: This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
