LEONCINI, City Clerk ORDINANCE NO. 1835 AN ORDINANCE OF THE CITY OF SAN RAFAEL REPEALING EXISTING CHAPTER 5.60 OF THE SAN RAFAEL MUNICIPAL CODE AND ENACTING A NEW CHAPTER 5.60 OF THE SAN RAFAEL MUNICIPAL CODE, REGARDING PARKING METER ZONES, PARKING METER RATES, AND RELATED RULES AND REGULATIONS APPLICABLE TO PARKING METERS. WHEREAS, this Ordinance is found to be exempt from environmental review, pursuant to the provisions of Public Resources Code Section 21080(b)(8), as relating to the collection of fees to meet operating expenses, costs for supplies, equipment and materials, reserve requirements, and capital expenses in the City's parking programs, and the provisions of 14 California Code of Regulations Section 15321(a), as relating to the enforcement of parking laws administered by the City, and the provisions of 14 California Code of Regulations Section 15061(b)(3), as being seen with certainty to have no possible significant effect on the environment. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS: DIVISION 1. Title 5 of the San Rafael Municipal Code is amended by repealing existing Chapter 5.60 (Parking Meters) and enacting new Chapter 5.60 (Parking Meters) to read as follows: CHAPTER 5.60 PARKING METERS Sections: 5.60.010 Parking Meter Zones. 5.60.020 Installation and Maintenance of Parking Meters. 5.60.030 Parking Meter Time Limits. 5.60.040 Curb or Street Lines or Markings. 5.60.050 Unlawful Parking. 5.60.055 Parking Meters, Exclusive Use of. 5.60.060 Parking Meter Rates. 5.60.080 Deposit of Payment Required. n 5.60.090 Improper Use of Meter. 5.60.100 Notice of Parking Violations. 5.60.120 Disposition and Use of Revenue. Section 5.60.010 - Parking Meter Zones. The City streets located within the following boundaries, including both sides of each street named herein, are hereby established as parking meter zones: • Northern boundary shall be MISSION AVENUE. • Southern boundary shall be SECOND STREET. • Western boundary shall be H STREET. • Eastern boundary shall be HETHERTON STREET. Section 5.60.020 - Installation and Maintenance of Parking Meters. The City Engineer is authorized and directed to install the necessary Parking Meters in all of the designated parking meter zones and in such off-street parking facilities operated by the City as shall be specified by Council Resolution, for the purpose of, and in such numbers, and at such places, and for such time limits as to provide for the efficient control and regulation of the parking of vehicles therein. Section 5.60.030 - Parking Meter Time Limits. The City Engineer may install parking meters in the parking meter zones and off-street parking facilities operated by the City with the following maximum time limits: twelve (12) minutes, fifteen (15) minutes, twenty (20) minutes, twenty-four (24) minutes, thirty (30) minutes, one (1) hour, ninety (90) minutes, two (2) hours, three (3) hours, four (4) hours, five (5) hours, ten (10) hours, and twelve (12) hours. The maximum time limit, days and hours of operation, parking rate, and payments accepted by parking meters shall be indicated on said meters. Section 5.60.040 - Curb or Street Lines or Markings. The City Engineer shall have lines or markings painted or placed upon the curb, street, or in off-street parking facilities operated by the City, adjacent to each parking meter, designating the 2 parking space for which the parking meter is to be used, and each vehicle parked adjacent or next to any parking meter shall park within the lines or markings so established. It is unlawful to park a vehicle of such size or in such a position that the same shall not be entirely within the space designated by such lines or markings. Section 5.60.050 - Unlawful Parking. It is unlawful for any person between the hours of eight (8) a.m. and six (6) p.m. of any day to cause or permit any vehicle registered in his name or operated by him to be parked continuously in any parking meter space within any parking meter zone or off-street parking facility operated by the City, for more than the maximum period of time indicated on said parking meter, or any time during which the meter is displaying a signal indicating that the space is illegally in use, except during the time necessary to set the meter to show legal parking, and excepting also during the time from six (6) p.m. to eight (8) a.m., and on Sundays and holidays. Section 5.60.055 - Parking Spaces, Exclusive Use Of. Temporary utilization of parking spaces located in the parking meter zones or off-street parking facilities operated by the City, without the deposit of payment or for a period of time longer than the maximum time limit of said parking space, may be granted by the City upon application for such permission. The application shall be submitted in writing to the Parking Services Division or Police Department and shall provide substantial need for temporarily closing off these spaces for a stated duration of time. The applicant for temporary utilization of metered parking spaces in parking meter zones shall pay the City thirty-five ($35.00) dollars for the first meter for the first day of each application and fifteen ($15.00) dollars per meter for each day thereafter, plus thirty-five ($35.00) dollars for the first sign for each application and two ($2.00) dollars for each additional sign. The applicant for temporary utilization of metered parking spaces in off-street parking facilities operated by the City shall make payments to the City as established by Council Resolution. Upon receipt of 3 these payments, official bags shall be placed or signs shall be provided for posting on said parking spaces. This provision shall not permit anyone to occupy a parking space during a posted no -parking period. Section 5.60.060 - Parking Meter Rates. The rates for parking meter spaces located in the parking meter zones shall be as follows: All spaces on FOURTH STREET from HETHERTON STREET to the East to H STREET to the West shall be eighty ($.80) United States cents per hour. All other spaces set forth in Section 5.60.010 shall be sixty-five ($.65) United States cents per hour. The rates for parking meter spaces located in off-street parking facilities operated by the City shall be set forth by Council Resolution. Section 5.60.080 - Deposit of Pavment Required. When any vehicle is parked in any unpaid parking space as provided in accordance with the provisions of this chapter, the operator of the vehicle upon so parking shall, and it is unlawful to fail to, deposit immediately United States coins, currency, or other such payment that is available and/or operational for parking spaces located within the parking meter zones and in off-street parking facilities operated by the City. Section 5.60.090 - Improper use of Parking Meters. It is unlawful to deposit or cause to be deposited in any parking meter, any slug, device or non -accepted payment material, or to deface, injure, tamper with, open, willfully break, destroy, or impair the usefulness of any parking meter installed pursuant to this chapter. Section 5.60.100 - Notice of Parking Violation. It shall be the duty of each police officer or employee of the Police Department as designated by the Police Chief, and each Department of Management Services employee assigned to the enforcement of parking laws and regulations, to observe any vehicles that are parked in parking 4 meter zones or off-street parking facilities operated by the City in violation of this chapter or the California Vehicle Code, and to issue and attach to such vehicles a Notice of Parking Violation as provided by law. Section 5.60.120 - Disposition and Use of Revenue. The depositing of payment in parking meters as provided in this chapter is levied and assessed as fees for the purposes provided in this section. All receipts accruing to the City from the operation of these parking meters shall be expended for the acquisition, installation, operation, maintenance, repair and replacement of parking meters, parking meter collection and enforcement and expenses incidental thereto; the acquisition by purchase, condemnation or lease, installation, improvement, operation, maintenance, repair and replacement of off-street parking facilities and expenses incidental thereto, including costs and expenses incurred in condemnation proceedings whether successfully concluded or abandoned; and expenses incurred in connection with proposals or proceedings for acquisition of off-street parking facilities, whether such proposals or proceedings are carried out or abandoned. Excess revenue not expended for the foregoing purposes shall be kept as reserves in the City's Parking Services Fund or expended for any lawful purpose. DIVISION 2. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. 5 DIVISION 3. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael and shall be in full force and effect thirty (30) days after its final passage.
