EONC , City Clerk ORDINANCE NO. 1749 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING TITLE 14 OF THE SAN RAFAEL MUNICIPAL CODE (CITY OF SAN RAFAEL ZONING ORDINANCE), CHAPTER 16, SECTION 14.16.030 (AFFORDABLE HOUSING REQUIREMENTS) TO LOWER THE AFFORDABLE HOUSING STANDARDS FOR NEW BELOW MARKET RATE (BMR) RENTAL UNITS (ZC 99-8) WHEREAS, in January 2000, the City of San Rafael initiated amendments to specific policies, programs and provisions of the San Rafael General Plan 2000 and Section 14.16.030 of the San Rafael Municipal Code with the intent to lower the affordable housing standards for new below market rate (BMR) rental units; and WHEREAS, on February 29, 2000, the Planning Commission held a public hearing on the proposed Zoning Ordinance text amendments, accepting public testimony and the written report of the Department of Community Development; and WHEREAS, the San Rafael City Council has recommended adoption of a Negative Declaration by adoption of a separate resolution. WHEREAS, the City Council adopts the following findings in support of the amendment as required under Zoning Ordinance Section 14.16.030: 1. The proposed text amendment would be consistent in principle with the San Rafael General Plan 2000. Specifically, the text amendment would address the need to provide rental housing in new market rate and affordable housing projects that would be affordable to very low- (50% of less of the median) and low- (50-80% of the median) income households. San Rafael General Plan Housing Element Goal H -A encourages the provision of habitable dwellings that meet the needs of all economic segments of the community. Likewise, the proposed text amendment would be consistent with Housing Element Policies H-19 and H-20, which establish the below market rate (BMR) unit requirements FOR new market rate and affordable housing projects. 2. The public health, safety and welfare of the community would be served by the adoption of the proposed text amendment. By adoption of this ordinance, a portion of the new rental units developed in the community would become affordable to a lower income segment of the population, which would enhance the welfare of the community. THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY ORDAIN AS FOLLOWS: DIVISION 1. Chapter 16, Section 14.16.030 (Affordable Housing Requirements) is amended to read as follows: Development of ten or more lots or dwelling units shall be required to provide at least ten percent of their units affordable to low- and moderate -income households for at least 40 years. For projects providing for sale/ownership units, the below market rate units shall be affordable to moderate -income households at 80-100 percent of the median for 40 years. For projects providing rental units, the below market rate units shall be affordable to low-income households at 50-80 percent of the median for 40 years. These below market rate units should be of similar mix and type to that of the development as a whole, and dispersed throughout the development. Should on-site construction prove impractical, an equal value alternative may be allowed, as approved by the City Council. DIVISION 2. This ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
