JEA " LEONCINI, City Clerk ORDINANCE NO. 1695 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING CHAPTER 14.25.050 AND THE TITLE 14 ZONING MAP OF THE MUNICIPAL CODE OF THE CITY OF SAN RAFAEL TO HELP IMPLEMENT THE MONTECITO/HAPPY VALLEY NEIGHBORHOOD PLAN WHEREAS, the Planning Commission has held a duly -noticed public hearing on the proposed amendments to the zoning ordinance as required by State law and has considered all written correspondence, verbal testimony and the staff reports and memos relevant to the proposed amendments and has recommended to the City Council approval of the proposed amendments; and WHEREAS, the City Council has held a duly -noticed public hearing on the proposed amendments to the zoning ordinance and has considered all written correspondence, verbal testimony and the staff reports and memos; and WHEREAS, the proposed amendments are consistent in principle with the General Plan and serve the public health, safety and general welfare based on the following specific findings: a. The amendments, including the revised zoning map, are consistent with the General Plan maps and policies. Some multi -family -zoned residential areas are being rezoned from higher density to lower density zoning, consistent with neighborhood direction to minimize change and that the area maintain the existing diverse mix of residential uses. The existing single-family zoning is expanded to include adjacent lots with single family homes, and to include clusters of other single-family lots. High density zoning is kept where most lots are already developed at high density. Medium density zoning is provided through much of the neighborhood's multi family areas, reflecting the predominant existing uses in these areas. Residential design guidelines will help improve the appearance of the neighborhood as changes are made over time. b. These amendments serve the public health, safety and general welfare by stabilizing and protecting the existing mix of uses recognizing the constraints of the narrow streets and sloping and small lots, and zoning and design standards, and by enhancing the sense of community as well as the appearance of the neighborhood over time. THE COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS: DIVISION 1. Chapter 14.25.050 of the Zoning Ordinance is amended as follows. "14.25.050 Review Criteria B. Consistencv with Snecific Plans. In addition to the criteria listed below, development will also be evaluated for consistency with applicable neighborhood and area design plans. Adopted plans which include design guidelines include: Hillside Residential Design Guidelines Manual, Shoreline Park Master Plan, East San Rafael Neighborhood Plan, Peacock Gap Neighborhood Plan, and Sun Valley/Fairhills Neighborhood Plan. In addition, the following design guidelines have been adopted by resolution and apply to specific areas in San Rafael: the Downtown Design Guidelines, and the Montecito/Happy Valley Residential Design Guidelines." DIVISION 2. The Zoning Map of the City of San Rafael is hereby amended as shown in Exhibit A. DIVISION 3. This zoning amendment shall become effective in accordance with Section 65859 of the Government Code of the State of California. DIVISION 4. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. DIVISION 5. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. 6----ly .
