Clerk of the Council of said City, do hereby certify that the foregoing Charter
Ordinance No. 1716 entitled:
"AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN R RAFAEL
AMENDING SECTIONS 8.20.160 AND 8.20.165 OF THE SAN RAFAEL MUNICIPAL
CODE RELATING TO RESPONSES TO FALSE ALARMS AND FALSE ALARM RESPONSE
FEES"
is a true and correct copy of an Ordinance of said City and was introduced at a
REGULAR meeting of the City Council of the City of San Rafael, held on the 20th day
of OCTOBER, 1997, published as required by City Charter in the MARIN INDEPENDENT
JOURNAL, a newspaper published in the City of San Rafael and passed and adopted as
an ordinance of said City at a REGULAR meeting of the City Council of said City held
on the 3rd day of NOVEMBER, 1997, by the following vote, to wit:

ORDINANCE NO. 1716
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL AMENDING SECTIONS 8.20.160 AND
8.20.165 OF THE SAN RAFAEL MUNICIPAL CODE
RELATING TO RESPONSES TO FALSE ALARMS AND
FALSE ALARM RESPONSE FEES
WHEREAS, the City Council of the City of San Rafael finds that City wastes valuable
time and resources when Police Department personnel and equipment respond to false alarms;
and
WHEREAS, the City Council of the City of San Rafael has determined that three or
more false alarms at a given location within a one year period constitutes a public nuisance; and
WHEREAS, the City Council of the City of San Rafael has determined that the owner or
lessee of the property where the alarm device is located should be responsible for reimbursement
of the City of San Rafael Police Department costs of responding to three or more false alarms in
a one year period.
NOW THEREFORE, the City Council does ordain as follows:
DIVISION 1:
San Rafael Municipal Code Sections 8.20.160 and 8.20.165 are amended to read as
follows:
Section 8.20.160 -- False alarm -Public Nuisance When.
A protected area device shall constitute a public nuisance if it actuates three or more false
alarms in any calendar year. This section shall be effective thirty days after installation
operational.

Section 8.20.165 -- False Alarm Response Fee.
If a protected area alarm becomes a public nuisance as defined in Section 8.20.160, the
owner or lessee shall be responsible for the City's false alarm response fees as set in the Master
Fee Schedule adopted by Resolution of the City Council pursuant to Chapter 3.34 of this Code.
DIVISION 2:
If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason
held to be invalid, such decision shall not affect the validity of the remaining portions of this
Ordinance. The Council hereby declares that it would have adopted the Ordinance and each
section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses or phrases be declared invalid.
DIVISION 3:
This Ordinance shall be published once in full before its final passage in a newspaper of
general circulation, published, and circulated in the City of San Rafael, and shall be in full force and
effect thirty (30) days after its final passage.
