LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1727 entitled: "AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING ORDINANCE 1699 (PARAMEDIC SERVICE SPECIAL TAX) AND SETTING THE PARAMEDIC TAX RATE, COMMENCING WITH FISCAL YEAR 1998/99 FOR RESIDENTIAL AND NON- RESIDENTIAL PROPERTIES" is a true and correct copy of an Ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the 6th day of JULY, 1998, published as required by City Charter in the MARIN INDEPENDENT JOURNAL, a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the 20th day of JULY, 1998, by the following vote, to wit: AYES: COUNCILMEMBERS: Cohen, Heller, Miller, Phillips and Mayor Boro NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None WITNESS my hand and the official seal of the City of San Rafael this 22nd day of JULY, 1998. c.-ar A. JEANN LEONCIN�ty,erk ORDINANCE NO. 1727 An ordinance of the City of San Rafael amending Ordinance 1699 (Paramedic service Special Tax) and setting the Paramedic Tax rate, commencing with fiscal year 1998/99 for residential and non-residential properties. WHEREAS, the electors of the City of San Rafael in 1979 and in 1988, adopted a paramedic service tax (Chapter 3.28 of the San Rafael Municipal Code) to be imposed annually upon all residential and commercial properties within the City of San Rafael; and WHEREAS, the City Council has the authority under the paramedic tax ordinance, to revise the amount of this tax, within certain limits, based upon a budget recommendation of the City Manager; and WHEREAS, the passage of Proposition 218 by the voters of the State of .California in November of 1996 and the subsequent approval of SB919 by the State Legislature limited the ability and scope under which the City Council has the authority to revise the amount of this tax; and WHEREAS, the City Council, after reviewing the proposed budget recommendation of the City Manager, finds that the basic paramedic tax rate needs to be changed to reflect changes in the charges and costs of providing paramedic service, and that the current tax rate is insufficient to cover the costs of providing paramedic service; THEREFORE, the City council of the City of San Rafael does ordain as follows: Division 1 Pursuant to Chapter 3.28, Section 3.28.060 thereof, the Council of the City of San Rafael does hereby set the basic residential tax rate for paramedic service at $40.00 per living unit within the City limits, and hereby increases a tax rate to $.05 per square foot on nonresidential properties. Division 2 The Council hereby determines that the basic tax rate shall be revised to partially, but not wholly, cover the cost of providing paramedic service, based upon a budget recommended by the City Manager. Division 3 If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid such holding or holdings shall not affect the validity of the remaining portions of this ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid. Division 4 This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. / A rt J.
