LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1659 entitled: "AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.01.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA SO AS TO RECLASSIFY CERTAIN REAL PROPERTY IN THE TERRA LINDA AREA (RE: Z91-6 - 1 TRINITY WAY - A 62 -UNIT AFFORDABLE SENIOR HOUSING PROJECT, AP 175-181-26) (ST. ISABELLA'S SENIOR HOUSING PROJECT)" is a true and correct copy of an ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the 7th day of FEBRUARY. 1994, published as required by City Charter in the MARIN INDEPENDENT JOURNAL , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the 22st day of FEBRUARY. 1994, by the following vote, to wit: AYES: COUNCILMEMBERS: Heller, Thayer, Zappetini & Mayor Boro NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Cohen WITNESS my hand and the official seal of the City of San Rafael this 8th day of MARCH, 1994. JEA LEONCINI, City Clerk ORDINANCE NO. 1659 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.01.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY IN THE TERRA LINDA AREA (RE: Z91-6 - 1 TRINITY WAY - A 62 -UNIT AFFORDABLE SENIOR HOUSING PROJECT, AP 175-181-26) (ST. ISABELLXS SENIOR HOUSING PROJECT) THE COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS: WHEREAS, the San Rafael Planning Commission has held a duly -noticed public hearing on the proposed amendment to the zoning map as required by State Law and has considered all written correspondence, verbal testimony and the staff reports relevant to the proposed amendment, and recommended to the City Council approval of the proposed amendment; and WHEREAS, the San Rafael City Council finds that the proposed amendment to the zoning map is consistent in principle with the General Plan, adopted Northgate Activity Center Plan, and other applicable plans or policies; and WHEREAS, the San Rafael City Council finds that the Development Plan is appropriate in area, location and overall planning for the purpose intended, and the Project shall constitute a residential environment of sustained desirability in harmony with the character of the surrounding neighborhood, and adequate open space has been provided; and WHEREAS, the San Rafael City Council finds that the development is improved by deviations from typical Zoning Ordinance property development standards because greater landscape buffer areas, greater building setbacks, and development standards set forth for landscaping and architecture will provide for higher quality development on the site; and WHEREAS, the San Rafael City Council finds that the auto, bicycle and pedestrian traffic system is adequately designed for circulation needs and public safety and emergency vehicle access is provided to serve the proposed development based on the information contained in the project application and the Initial Study and review by the City's Fire, Police, and Public Works Departments; and WHEREAS, the San Rafael City Council finds that public health, safety and general welfare are served by the adoption of the proposed amendment to the zoning map; and URIGINAL,*,6_59 WHEREAS, the San Rafael City Council incorporates into this preamble the findings made and set forth in the Findings Pertaining to General Plan Amendment Application GPA93-2, Rezoning Application Z91-6, Tentative Subdivision Map S91- 6, Conditional Use Permit Application UP91-3, Environmental and Design Review Permit ED91-69, and Trip Permit Application T93-1 for the St. Isabella Affordable Senior Housing Project in the Terra Linda District of the City of San Rafael. THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.01.020 of the Municipal Code is amended by reclassifying the following real property from P -D (Planned Development) District to P -D (Planned Development) District. Said property so reclassified is located at 1 Trinity Way, San Rafael, (Exhibit "B") County Assessor's Parcel Number 175-181-26. DIVISION 2. Any development of this property shall be subject to the development standards outlined in Exhibit "A" which is attached hereto and made a part hereof. DIVISION 3. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. DIVISION 4. The Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. LEONCINL City Clerk - 3 - EXHIBIT "A" P -D Zoning Development Standards (a) This P -D zoning is approved for development of the following: Land Uses: A maximum of sixty-one one -bedroom apartments for seniors and a two-bedroom manager's unit in a 47,546 square foot building, with appropriate support staff and facilities. Area: 2.67 Acres (116,515 square feet) Setbacks: 33 feet from the south property line, 23 feet from the eastern property line at the southern portion of the site, 14 feet, 3 inches from the eastern property line at the northern portion of the site, 11 feet, 8 inches from the northern property line along Freitas Parkway. Coverage: 23.7% or 27,615 square feet. Specific Architectural Standards: Maximum building height of two stories or 28.5 feet as measured by UBC, with a total second floor area of 19,439 square feet. PM Peak Trips: The parcel has been assigned an additional 8 General Plan 2000 trips. Based on a traffic study, the project will generate 12 PM Peak Trips. Four bonus trips from the affordable housing reserve are being allocated to this project. Parking: 47 parking spaces are proposed for this project, based on the draft zoning ordinance standard of .75 space per unit. In addition, an additional 6 spaces are available per an agreement with St. Isabella Parish. Circulation: Access shall be from a private street built to City standards. (b) All conditions of UP91-53, ED91-69, s91-6, T93-1 and Z91-6 shall apply. Legal Description Lot 1 Real property situate in the City of San Rafael, County of Marin, State of California, more particularly described as follows: Beginning at the northeast corner of Lot 68 as said lot is shown and depicted upon that certain map entitled "Map of Terra Linda No. 11, in the City of San Rafael, California", recorded March 23, 1960 in Book 10 of Maps at Page 54, Marin County Records, said point also being on the exterior boundary line of said referred map; thence along said exterior boundary N 19050'00"E, 283.00 feet and N 34047'58"E, 197.47 feet to the northwesterly corner of Lot 76 and the southerly right of way of Manuel T. Freitas Parkway as said lot and right of way are shown and depicted upon said referred map; thence along said southerly right of way being the northwesterly prolongation of the southerly right of way of Manuel T.
