LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1662 entitled: "AN ORDINANCE AMENDING TITLE 11 OF THE SAN RAFAEL MUNICIPAL CODE TO AMEND CHAPTER 11.04 -- SIDEWALKS, DRIVEWAY APPROACHES, CURBS AND GUTTERS" is a true and correct copy of an ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the 18th day of APRIL, 1994, published as required by City Charter in the MARIN INDEPENDENT JOURNAL , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the 2nd day of MAY, 1994, by the following vote, to wit: AYES: COUNCILMEMBERS: Cohen, Heller, Thayer, Zappetini & Mayor Boro NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None WITNESS my hand and the official seal of the City of San Rafael this 4th day of MAY, 1994. !li - JEANf�4NCINI, ity Clerk ORDINANCE NO. 1662 AN ORDINANCE AMENDING TITLE 11 OF THE SAN RAFAEL MUNICIPAL CODE TO AMEND CHAPTER 11.04 -- SIDEWALKS, DRIVEWAY APPROACHES, CURBS AND GUTTERS THE COUNCIL OF CITY OF SAN RAFAEL, DO ORDAIN AS FOLLOWS: DIVISION 1: Title 11 of the Municipal Code of the City of San Rafael is hereby amended by revising Chapter 11.04, Sidewalks, Driveway Approaches, Curbs and Gutters to provide as follows: Section 11.04.100 -- Limitation on Width of Drivewav ADDroaches A. No driveway entrance or approach leading from the street into any property, premises, structure or building fronting thereon, shall be constructed or maintained which is: 1. Less than the minimum width required under the zoning ordinance; 2. Greater than 40 feet. No additional driveway entrance or approach shall be constructed or maintained into or from the same premises at any distance closer than 25 feet to any existing driveway entrance or approach. Where two or more driveway entrances or approaches are constructed at or about the same time, they shall be constructed so as to be separated by a sidewalk area or island not less than 25 feet in width at the narrowest point. B. Notwithstanding the prohibition of Subsection A., the Director of Public Works or his designee may grant, subject to review by the Design Review Board, an encroachment permit for the construction or maintenance of driveway entrances or approaches of any width or separation when the location or use of the subject property, public safety, or any other factors so require. DIVISION 2: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordi- nance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase 1 ORIGINAL _144 thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. DIVISION 3: This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
