LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1670 entitled: "AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING CHAPTER 10.60 OF THE SAN RAFAEL MUNICIPAL CODE, VEHICLES FOR HIRE, TO REVISE SECTION 10.60.050, REGARDING THE REVOCATION OF LICENSES, AND TO REVISE SECTION 10.60.080 INSURANCE REQUIREMENTS" is a true and correct copy of an ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the 7th day of NOVEMBER, 1994, published as required by City Charter in the MARIN INDEPENDENT JOURNAL , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the 21st day of NOVEMBER. 1994, by the following vote, to wit: AYES: COUNCILMEMBERS: Cohen, Heller, Thayer, Zappetini & Mayor Boro NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None WITNESS my hand and the official seal of the City of San Rafael this 22nd day of NOVEMBER, 1994. LEONCINI, ity Clerk ORDINANCE NO. 1670 AN ORDINANCE AMENDING CHAPTER 10.60 OF THE SAN RAFAEL MUNICIPAL CODE, VEHICLES FOR HIRE, TO REVISE SECTION 10.60.050, REGARDING THE REVOCATION OF LICENSES, AND TO REVISE SECTION 10.60.080 REGARDING INSURANCE REQUIREMENTS THE COUNCIL OF CITY OF SAN RAFAEL, DOES ORDAIN AS FOLLOWS: DIVISION 1: Section 10.60.050 of the Municipal Code of the City of San Rafael is hereby amended to read as follows: Section 10.60.050 ---- Suspension, alteration or revocation of license. A. The City Council may, at any time, after notice and hearing, and upon a finding of good cause, suspend, alter, amend or revoke any license issued under this Chapter. B. Any existing license shall be deemed automatically revoked upon the occurrence of any of the following: (1) The death of a natural person who is the licensee; (2) A change in the persons constituting a partnership that is the licensee; (3) A transfer of the assets of the licensee; (4) A transfer of a controlling interest in the corporation that is the licensee. To continue operation of its vehicles(s) for hire, the licensee must apply for and obtain a new license pursuant to the provisions of this Chapter. DIVISION 2. Section 10.60.080 of the Municipal Code of the City of San Rafael is hereby amended to read as follows: Section 10.60.080 ---- Insurance required. In order to provide for the safety of the public it is unlawful for any person to drive or operate upon any street or streets in the City any vehicle for the purpose of carrying passengers for hire, or to obtain a license therefore unless he/she shall have given and there is in full force and effect at all times when such person is driving or operating such vehicle a policy of insurance on file with the City Clerk. Said policy of insurance shall be with an admitted carrier in 0,RIGINAI California or a company with a BEST Rating of A or better. Said policy shall insure the owner or lessee of a vehicle against loss by reason of damage that may result to any person or persons or property from the operation of said vehicle. The policy of insurance shall have a combined single limit of $500,000. The policy shall guarantee payment of any final judgement rendered against the said owner or lessee of said vehicle within the limits herein provided irrespective of the financial responsibility or any act or omission of said owner or lessee. Said insurance policy shall include an endorsement to be filed with the City Clerk, which provides that said insurance policy shall not be cancelled, limited or non -renewed until after thirty (30) days advance written notice to the City. A duly executed certificate of insurance, evidencing the requirements, shall be filed with the application for a license, and shall be maintained by the City Clerk. Within thirty (30) days of annual policy renewals, a new certificate of insurance shall be filed by the licensee with the City Clerk. If at any time said policy of insurance be cancelled by the issuing company or the authority of said issuing company to do business in the State shall be revoked, or the issuing company fails to meet the City's minimum standards, the Council shall require the party to whom the license is issued to replace said policy with another policy satisfactory to the City Council and in default thereof said license may be revoked. DIVISION 3: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordi- nance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. DIVISION 4: This Ordinance shall be published once in full before its 2 final passage in a newspaper of general circulation, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
