LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1684 entitled: "AN ORDINANCE OF THE CITY OF SAN RAFAEL, AMENDING ORDINANCE NO. 1555 SO AS TO REMOVE THE ZONING CONDITION THAT REQUIRED A SUPPLEMENTAL PARKING EASEMENT AT 100 McINNIS PARKWAY FOR A RESTAURANT/HOTEL (RE: Z88 -1(b) EMBASSY SUITES HOTEL, 100 McINNIS PARKWAY, AP 180-410-07) is a true and correct copy of an ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the 21st day of AUGUST, 1995, published as required by City Charter in the MARIN INDEPENDENT JOURNAL , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the 5th day of SEPTEMBER. 1995, by the following vote, to wit: AYES: COUNCILMEMBERS: Cohen, Heller, Phillips, Zappetini & Mayor Boro NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None WITNESS my hand and the official seal of the City of San Rafael this 11th day of SEPTEMBER. 1995. JEAN ONCINI, City Clerk ORDINANCE NO. 1684 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING ORDINANCE NO. 1555 SO AS TO REMOVE THE ZONING CONDITION THAT REQUIRED A SUPPLEMENTAL PARKING EASEMENT AT 100 MCINNIS PARKWAY FOR A RESTAURANT/HOTEL (RE: Z88 -1(b) EMBASSY SUITES HOTEL, 100 MCINNIS PARKWAY, AP 180-410-07) THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS: WHEREAS, the San Rafael City Council wishes to amend Ordinance 1555 (Z88-1) by deleting the condition requiring a parking agreement for the hotel on the office site and finds that the amendment is consistent with the goals and policies set forth in the General Plan and other applicable plans or policies; and, WHEREAS, the San Rafael City Council finds that the public health, safety and general welfare are served by the adoption of the proposed amendment in that a parking study has demonstrated that an easement requiring hotel parking on the office site is not necessary. THE COUNCIL OF THE CITY OF SAN RAFAEL DOES FURTHER ORDAIN AS FOLLOWS: DIVISION 1. Pursuant to Title 14 (Zoning) of the City of San Rafael, Ordinance No. 1555 is amended to delete Condition No. 2 of Exhibit B of Ordinance No. 1555 which currently reads as follows: "(2) Concurrent with recordation of a parcel map and prior to the issuance of grading permits and building permits, an easement or other non -revokable agreement, prepared to the satisfaction of the City Attorney and Planning Director, shall be recorded, allowing parking of up to 200 vehicles from the hotel land use on the office site, (Parcel 2 of 23 PM 52), on each weekday from 5:30 p.m. to 8:00 a.m. and at all times on each Saturday and Sunday. The 200 spaces shall be paved and available for use prior to occupancy of the hotel." DIVISION 2. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared invalid. -1- ORIGINAI°eg g' DIVISION 3. This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
