Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1685
entitled:
"AN ORDINANCE OF THE CITY OF SAN RAFAEL ADDING CHAPTER 17.30 TO THE
SAN RAFAEL MUNICIPAL CODE CONCERNING WATERCRAFT TRAFFIC REGULATIONS."
is a true and correct copy of an ordinance of said City and was introduced at a REGULAR
meeting of the City Council of the City of San Rafael, held on the 5th day of
SEPTEMBER, 1995, published as required by City Charter in the MARIN INDEPENDENT JOURNAL ,
a newspaper published in the City of San Rafael and passed and adopted as an ordinance of
said City at a REGULAR meeting of the City Council of said City held on the 18th
day of SEPTEMBER, 1995, by the following vote, to wit:

ORDINANCE NO. 1685
AN ORDINANCE OF THE CITY OF SAN
RAFAEL ADDING CHAPTER 17.30 TO THE
SAN RAFAEL MUNICIPAL CODE CONCERNING
WATERCRAFT TRAFFIC REGULATIONS
THE COUNCIL OF CITY OF SAN RAFAEL, DO ORDAIN AS FOLLOWS:
DIVISION 1:
Chapter 17.30 is added to the San Rafael Municipal Code as
follows:
CHAPTER 17.30
WATERCRAFT TRAFFIC REGULATIONS
Section 17.30.010 -- Sneed Restrictions.
A. No persons shall operate a vessel, boat or other
watercraft on the waters or any canals or waterways within the San
Rafael city limits at a speed greater than is reasonable or
prudent, having due regard for other vessels, property and persons
on and in such waters or waterway, and in no event at a speed which
endangers the safety of persons or property;
B. Notwithstanding the basic speed rule established in
no person shall operate a vessel, boat or other watercraft at a
speed greater than five (5) miles per hour on that portion of the
San Rafael Canal, described as those waters of the San Rafael Canal
lying west of a line formed by the Pacific Gas & Electric Ignacio -
San Rafael power transmission lines running between the transmis-
sion line tower located on the north side of the San Rafael Canal
on the property commonly known as Seastrand Open Space and the
transmission line tower located on the south side of the San Rafael
Canal on the property commonly known as Pickleweed Park.
C. These speed restrictions shall not apply to vessels,
boats or watercraft operated by City of San Rafael or other peace
officers engaged in direct law enforcement activities.
D. Violations of this Section shall be penalized as provided
in Section 2.37.010 of this Code.
Watercraft speed zone and time -of -day regulations are
authorized by California Harbors and Navigation Code
section 660.

DIVISION 2:
If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held to be invalid, such decision shall
not affect the validity of the remaining portions of this Ordi-
nance. The Council hereby declares that it would have adopted the
Ordinance and each section, subsection, sentence, clause or phrase
thereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses or phrases be declared invalid.
DIVISION 3:
This Ordinance shall be published once in full before its
final passage in a newspaper of general circulation, published, and
circulated in the City of San Rafael, and shall be in full force
and effect thirty (30) days after its final passage.

The foregoing Ordinance No. 16.85 was read and introduced at a
Regular Meeting of the City Council of the City of San Rafael, held
on the 5th day of September, 1995, and ordered passed to print by
the following vote, to wit:

NOES: Councilmembers: None
ABSENT: Councilmembers: None
and will come up for adoption as an Ordinance of the City of San
