LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1619 entitled: "AN ORDINANCE AMENDING TITLE 2 OF THE SAN RAFAEL MUNICIPAL CODE TO ADD CHAPTER 2.37 - PENALTIES FOR VIOLATIONS FOR ENFORCEMENT OF ZONING, LAND USE AND OTHER VIOLATIONS OF THIS CODE" is a true and correct copy of an ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the 1st day of JUNE , 1992, published as required by City Charter in the MARIN INDEPENDENT JOURNAL , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the 15th day of JUNE 1992, by the following vote, to wit: AYES: COUNCILMEMBERS: Brei ner, Cohen, Shippey, Thayer & Mayor Boro NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None WITNESS my hand and the official seal of the City of San Rafael this 22nd day of JUNE 19 92. ONCINClerk ORDINANCE NO. 1619 AN ORDINANCE AMENDING TITLE 2 OF THE SAN RAFAEL MUNICIPAL CODE TO ADD CHAPTER 2.37 - PENALTIES FOR VIOLATIONS FOR ENFORCEMENT OF ZONING, LAND USE AND OTHER VIOLATIONS OF THIS CODE THE COUNCIL OF CITY OF SAN RAFAEL, DO ORDAIN AS FOLLOWS: DIVISION 1: Title 2 of the Municipal Code of the City of San Rafael is hereby amended by adding Chapter 2.37, Penalties for Violations and adding section 2.37.010 to provide as follows: Section 2.37.010 -- Penalty for Violations In accordance with section 1.12.010 of this code, a violation of any of the provisions of titles 1, 4, 6, excepting chapter 6.10 thereof, 9, 10, 11, 12, 13, 14, 16, 17, 18 and chapter 8.12 of Title 8 of this code, or of any codes adopted by reference in this code, is punishable as an infraction by a fine not exceeding five hundred ($500.00) dollars, or as a misdemeanor by a fine of not more than five hundred ($500.00) dollars, or by imprisonment in the Marin County Jail for a period of not more than six (6) months, or by both such fine and imprisonment. Each separate day or any portion thereof on which a violation occurs shall be deemed to constitute a separate offense punishable as herein provided. The fine and imprisonment herein provided in this penalty provision for a violation of the above title provisions shall supersede all similar or conflicting provisions of this code, or any codes adopted in the code by reference, if any, provided that no abatement proceedings by the City shall be affected or limited by this section. DIVISION 2: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be'invalid, such decision shall not affect the validity of the remaining portions of this Ordi- nance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase 1 CRIGINA1 thereof, irrespective of the fact that any one or more section, subsection, sentence,, clause or phrase be declared invalid. DIVISION 3: This Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published, and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
