LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1622 entitled: "AN ORDINANCE OF THE CITY OF SAN RAFAEL, TITLE 5, TRAFFIC REGULATIONS, BY AMENDING CHAPTER 5.40 STOPPING, STANDING AND PARKING OF THE SAN RAFAEL MUNICIPAL CODE BY AMENDING SECTION 5.40.040 AND ADDING SECTION 5.40.045 RELATING TO PARKING VEHICLES FOR SALE ON STREETS" is a true and correct copy of an ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the 20th day of JULY , 1992, published as required by City Charter in the MARIN INDEPENDENT JOURNAL , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the 3rd day of AUGUST 1992, by the following vote, to wit: AYES: COUNCILMEMBERS : Breiner, Shippey, & Mayor Boro NOES: COUNCILMEMBERS : Thayer ABSENT: COUNCILMEMBERS : Cohen WITNESS my hand and the official seal of the City of San Rafael this 19 92. 5th day of AUGUST , JEAN LEONCINI, City Clerk ORDINANCE NO. 1622 AN ORDINANCE OF THE CITY OF SAN RAFAEL, TITLE 5, TRAFFIC REGULATIONS, BY AMENDING CHAPTER 5.40 STOPPING, STANDING AND PARKING OF THE SAN RAFAEL MUNICIPAL CODE BY AMENDING SECTION 5.40.040 AND ADDING SECTION 5.40.045 RELATING TO PARKING VEHICLES AI4=RRR�=NGR=81�bR FOR SALE ON STREETS THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1: Title 5, Traffic Regulations, is hereby amended by amending Chapter 5.40 Stopping, Standing and Parking by amending section 5.40.040 and adding section 5.40.045 to provide as follows: Section 5.40.040 - Parkina for Certain Purposes Prohibited., No person shall park a vehicle upon any public street or roadwav for the principal purpose of: 1. Washing, greasing, or repairing the vehicle except repairs necessitated by an emergency; 2. Advertising a business, an address, a name, a trademark, a product, an event, or the sale of any real or personal property. Section 5.40.045 - Parking Vehicle for Sale. For the purposes of this ordinance, it shall be unlawful for any person to park a vehicle on a San Rafael City street or roadwav or other public property for the purpose of selling or hawking such vehicle. Hawking is the act of offering goods fpr sale by outcry, or by attracting the attention of persons by exposing goods in a public place, or by using placards, labels, signs or signals. 1. If a vehicle remains parked in the same location for more than six (6) hours and there is displayed a sign or some other means of communication on or near the vehicle stating the vehicle is for sale, there shall be a presumption that the vehicle owner is engaged in the principal purpose of offering such vehicle for sale. 2. To avoid a violation of this section, a vehicle must be moved five hundred (500) feet after a Police Department employee has marked the vehicle and placed a warning notice on such vehicle. 1 W A I DIVISION 2: If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The Council hereby declares that it would have adopted the ordinance and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid. DIVISION 3: This ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
