JEANNIJNl� LEONCINI4,C'ity Clerk ORDINANCE NO. 1634 AN ORDINANCE OF THE CM OF SAN RAFAEL ADOPTING THE PLANNED DEVELOPMENT DISTRICT 1634 FOR PORTO BELLO WEST, AS CLASSIFIED ON THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA (RE- Z91-4 SAN RAFAEL ZONING ORDINANCE) THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY ORDAIN AS FOLLOWS: DIVISION 1 Certain real property known as Porto Bello West is reclassified from PC (Planned Community) District to PD 1634 on the City of San Rafael Zoning Map as of the effective date of this ordinance. Said property so reclassified is located on Royal Court, San Rafael, County Assessor's Parcels 9-181-01 to -19 (Map 1), and further recorded in Book 13 of Recorded Maps at Page 20 (Map 2). This rezoning supercedes Ordinances Nos. 799, 815, and 1465. DIVISION.2 Any development of Porto Bello West shall be subject to the following development standards. Land Uses: Permits 18 condominium units and associated common recreation facilities. Also permits open space and accessory structures and uses customarily incidental to a permitted use and contained on the same site. Area: Approximately 2 acres. Setbacks: Setbacks are 10 feet front, 5 feet side except 0 feet side (common wall), and 6 feet rear. Height: Building height limits are 30 feet (main dwellings) and 15 feet (accessory buildings), provided, however, that lower heights may be required to be compatible with the existing project. DIVISION -a If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases maybe declared invalid. DIVISION 4 The Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty days following its final passage. ti ALBERT J.
