JEANNE U \\ LEONCINI; City Clerk ORDINANCE NO. 1.6. 8 AN ORDINANCE OF THE CITY OF SAN RAFAEL ADOPTING THE PLANNED DEVELOPMENT DISTRICT 16 3 8 FOR THE TERRACE, AS CLASSIFIED ON THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA (RE.: Z91-4 SAN RAFAEL ZONING ORDINANCE) THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY ORDAIN AS FOLLOWS: DIVISION -1 Certain real property known as The Terrace is reclassified from PC (Planned Community) District to PD 16 3 8 on the City of San Rafael Zoning Map as of the effective date of this ordinance. Said property so reclassified is located on Biscayne Drive, San Rafael, County Assessor's Parcels 184-190-01 through 16, and Community Site Block "A" Common Area, as described in the Map. This rezoning supersedes Ordinance No. 625. DIVISION -2 Any development of The Terrace shall be subject to the following development standards. Land Uses: Permits 16 residential lots, open space and accessory structures and uses customarily incidental to a permitted use and contained on the same site. Setbacks: Building setbacks shall be no less than 15 feet front, and 5 feet rear. The side setback at the east and west project boundaries shall be no less than 5 feet. Height: Building height limits are 30 feet (main dwelling) and 15 feet (accessory buildings); however, lower heights may be required to be compatible with the existing project. DIVISION 3 If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases may be declared invalid. DIVISION 4 The Ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty days following its final passage. /L�ErtTPBO ayor ATTEST: JgANINIE M.
