Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1639
entitled:
"AN ORDINANCE OF THE CITY OF SAN RAFAEL ADOPTING THE PLANNED DEVELOPMENT
DISTRICT 1639 FOR VILLA MARIN RETIREMENT RESIDENCES, AS CLASSIFIED ON THE
ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA (RE: Z91-4 ZONING ORDINANCE)
is a true and correct copy of an ordinance of said City and was introduced at a REGULAR
meeting of the City Council of the City of San Rafael, held on the 8th day of
SEPTEMBER , 1992, published as required by City Charter in the MARIN INDEPENDENT
JOURNAL , a newspaper published in the City of San Rafael and passed and adopted as an
ordinance of said City at a REGULAR meeting of the City Council of said City held on
the 21st day of SEPTEMBER , 1992, by the following vote, to wit:
AYES: COUNCILMEMBERS: Breiner, Cohen, Shippey, Thayer & Mayor Boro
NOES: COUNCILMEMBERS: None

ORDINANCE NO. 1639
AN ORDINANCE OF THE CITY OF SAN RAFAEL ADOPTING
THE PLANNED DEVELOPMENT DISTRICT 1639 FOR
VILLA MARIN RETIREMENT RESIDENCES,
AS CLASSIFIED ON THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA
(RE.: Z91-4 SAN RAFAEL ZONING ORDINANCE)
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY ORDAIN AS FOLLOWS:
DIVISION 1
Certain real property known as Villa Marin Retirement Residences is reclassified from PC -NG
(Planned Community-Northgate Activity Overlay) on Assessor parcels 175-360-07 and -10, and from
PC -NG (0-533) (Planned Community-Northgate [General Office -533 PM Peak Hour Trips]) on Assessor
page 175-42 to PD 1639 on the City of San Rafael Zoning Map as of the effective date of this
ordinance. Said property so reclassified is located on Thorndale Drive, San Rafael, County Assessor's
parcels 175-360-07 and -10 (Map 1) and Assessor's page 175-42 (Map 2), and as recorded in Book 18 of
Recorded Maps at Page 91, Marin County Official Records (Map 3). This rezoning supersedes
Ordinances No. 851, 880, and 956.
DIVISION 2
Any development of Villa Marin Retirement Residences shall be subject to the following development
standards.
Land Uses: Permits 225 senior retirement units with ancillary facilities. Also permits open space and
accessory structures and uses customarily incidental to a permitted use and contained on the same site.
Assessor Parcel 175-420-01 shall be common area. On parcel 175-360-10,11.63 acres is restricted to open
space and vineyard uses. On parcel 175-360-07, open space and vineyard uses are permitted uses. A
tennis court or similar low -intensity recreation facility may be allowed on parcel 175-360-07 with a Use
Permit. Commerce Clearing House, or subsequent owners of the office development on parcel 175-360-04,
shall be notified should any development be proposed on parcel 175-360-07.
Project Approvals: Development shall be in accordance with project approvals UP82-06, ED82-54 and
TS82-4, or any amendments thereto.
DIVISION 3
If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The
Council hereby declares that it would have adopted the Ordinance and each section, subsection,
sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections,
sentences, clauses or phrases may be declared invalid.
DIVISION 4
The Ordinance shall be published once in full before its final passage in a newspaper of general
circulation, published and circulated in the City of San Rafael, and shall be in full force and effect
thirty days following its final passage.

The foregoing Ordinance No. 1639 was read and introduced at a regular meeting of the City
Council of the City of San Rafael on Tuesday, September 8th, 1992, and ordered passed to print by the
following vote, to wit:
AYES: Councilmembers: Breiner, Cohen, Shippey, Thayer & Mayor Boro
NOES: Councilmembers: None
ABSENT: Councilmembers: None
and will come up for adoption as an Ordinance of the City of San Rafael at a regular meeting of the
Council to be held on Monday, September 21st, 1992.
