LEONCINI, Clerk of the City of San Rafael, and Ex -Officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance NO. 1577 entitled: "AN ORDINANCE OF THE CITY COUNCIL OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM P -D (PLANNED DEVELOPMENT) DISTRICT TO P -D (PLANNED DEVELOPMENT DISTRICT (855 "C" Street) (Z88-7) ("CENTERTOWN" PROJECT)" is a true and correct copy of an ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the SIXTH day of NOVEMBER , 19 89 , published as required by City Charter in the MARIN INDEPENDENT JOURNAL , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the 20TH day of NOVEMBER 19 89 by the following vote, to wit: AYES: COUNCILMEMBERS: Boro, Thayer & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Breiner & Shippey WITNESS my hand and the official seal of the City of San Rafael this 21st . day of November, 19 89 JEANNE ONCINI, City Clerk ORDINANCE N0. 1577 AN ORDINANCE OF THE CITY COUNCIL OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA, ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM P -D (Planned Development) DISTRICT TO P -D (Planned Development) DISTRICT ( 855 "C" Street) Q88-7� ("CENTERTOW " PR JECT) THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Municipal Code is amended by reclassifying the following real property from "P -D" (Planned Development) District to "P -D" (Planned Development) District. Said property so reclassified is located at 855 "C" Street, San Rafael, County Assessor's Parcel 1 1- 254-18 and 07 which is more particularly described in Exhibit "A" attached hereto. DIVISION 2. Any development of this property shall be subject to the conditions outlined in Exhibit "B" attached hereto. DIVISION 3. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such holding or holdings shall not affect the validity of the remaining portions of this ordinance. The Council declares that it would have passed this ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. DIVISION 4. This ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (3 0) days after its final passage. LEONCINI, City Clerk Exhibit "A" LEGAL DESCRIPTION Parcel A All that certain real property situate in the City of San Rafael, County of Marin, State of California, described as follows: "Map of Centertown an Air -space Condominium. Also being a reversion to acreage being the Lands of U.F. Service Corp., a California Corporation, as described by Deed recorded under Recorder's Serial No. 83-16358, Marin County Records and a portion of the lands described by the Record of Survey filed in Book 18 of Surveys, at Page 47, Marin County Records", filed for record December 13, 1983 in Volume 18 of Maps, at Page 98, Marin County Records. Parcel B All that certain real situate in the City of San Rafael, County of Marin, State of California, described as follows: BEGINNING at a point on the Westerly line of C Street distant thereon 109 feet 8 inches Northerly from the intersection of said Westerly line of C Street and the Northerly line of Second Street said point of beginning being the Southeast corner of that lot conveyed by Loretta Ceaser to John Mirata by Deed recorded in Book 165 of Deeds, page 269, running thence Westerly at a right angle to C Street and along the Southerly line of the Lot so conveyed by Ceaser to Mirata 150 feet; thence Southerly at a right angle 42 feet; thence Easterly at a right angle 150 feet to the Westerly line of C Street thence Northerly along the said line of C Street 42 feet to the point of beginning. EXHIBIT "B" Conditions which were included as part of the Zoning action (Z88-7) by the Planning Commission on April 25, 1989: (a) This P -D zoning is approved for a 60 -unit apartment complex that is intended for small families as depicted by the conceptual plans dated April, 17, 1989. This project will include 1, 2, and 3 -bedroom units. In addition to parking spaces provided on-site, there will be approximately 52 parking spaces available in City -owned parking facilities near the project site. (b) To satisfy the requirement for affordable housing, 17 of the 60 units, or 28%, will be made available to households earning 80% or less of the median income for the region. (c) All conditions of UP88-115, ED88-123, and V88-26 and any subsequent modification thereof shall be satisfied. (d) The P -D rezoning is valid for 18 months, or until June 5, 1990, unless an extension is granted. If any of the project approvals expire, the rezoning shall become null and void.
