LEONCINI, Clerk of the City of San Rafael, and Ex -Officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1594 entitled: "AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM PD-NG(C-172) (PLANNED DEVELOPMENT COMBINED WITH NORTHGATE OVERLAY) DISTRICT TO PD-NG(C-172) (PLANNED DEVELOPMENT COMBINED WITH NORTHGATE OVERLAY) DISTRICT (3833 Redwood Highway)" is a true and correct copy of an ordinance of said City and was introduced at a REGULAR meeting of the City Council of the City of San Rafael, held on the 4th day of September 1990, published as required by City Charter in the Marin Independent Journal a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a REGULAR meeting of the City Council of said City held on the 17th day of September , 1990, by the following vote, to wit: AYES: COUNCILMEMBERS: NOES: COUNCILMEMBERS: ABSENT: COUNCILMEMBERS: ABSTAINING: COUNCILMEMBERS: Boro, Thayer & Vice -Mayor Breiner None Mayor Mulryan Shippey WITNESS my hand and the official seal of the City of San Rafael this 18th day of September, 1990. JEA �01CINI City C erk ORDINANCE NO. 1594 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING THE ZONING MAP OF THE CITY OF SAN RAFAEL, CALIFORNIA ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA SO AS TO RECLASSIFY CERTAIN REAL PROPERTY FROM PD-NG(C-172) (PLANNED DEVELOPMENT COMBINED WITH NORTHGATE OVERLAY) DISTRICT TO PD-NG(C-172) (PLANNED DEVELOPMENT COMBINED WITH NORTHGATE OVERLAY) DISTRICT (3833 Redwood Highway) THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: DIVISION 1. The Zoning Map of the City of San Rafael, California, adopted by reference by Section 14.15.020 of the Municipal Code is amended by reclassifying the following real property from existing PD -NG (C- 172), (Planned Development Base Zoning and Northgate Overlay Districts with assigned Retail/Service Traffic Distribution Pattern and 172 PM Peak Hour Trip Generation Allowance) to PD -NG (C-172), (Planned Development Base Zoning and Northgate Overlay Districts with assigned Retail/Service Traffic Distribution Pattern and 172 PM Peak Hour Trip Generation Allowance). Said property so reclassified is located at 3833 Redwood Highway, San Rafael, County Assessor's Parcels AP 179-041-27 and 28 and described in Exhibit "B" attached. DIVISION 2. Any development of this property shall be subject to the conditions outlined in Exhibit "A" which is attached hereto and made a part hereof. DIVISION 3. LEONCINI, City Clerk EXHIBIT "A" Conditions which were included as part of the zoning (Z90-2) action by the Planning Commission on August 14,1990. (a) The site is approved for 18,000 gross square feet for use as a learning center for training developmentally disabled adults, and said zoning approval is contingent upon all conditions specified under accompanying use permit UP90-22 or future amendments. (b) This approval shall be valid for 18 months or until September 4, 1992, and shall become null and void if the site is not occupied by that date pursuant to conditions of the UP90-22. l EXHIBIT "B" DESCRIPTION: All that certain real property situate in the City of San Rafael, County of Marin, State of California, described as follows: Lot B, as shown and delineated on that certain map entitled "Division of Lands of Jacobson and Clayton" filed in Book 21 of Parcel Maps at Page 6, Marin County Records on February 9, 1983.
