SUBJECT: REPORT ON BID OPENING FOR THE SANTA MARGARITA PARK
TENNIS AND BASKETBALL COURT RENOVATION, PROJECT NO.
11159.
RECOMMENDATION: Reject all bids and rebid project.
BACKGROUND:
The project was advertised in October 4, 2010, and opened bids in October 26, 2010.
The following contractors submitted proposals:
1. Able Fence $132,602.05
2. Maggiora & Ghilotti, Inc. $143,456.00
3. Ghilotti Brothers, Inc. $153,653.00
4. CF Contracting $159,734.00
5. Ghilotti Construction Company $207,462.00
6. John Benward Company $238,571.02
Engineer's Estimate is $132,126.00
ANALYSIS:
The City has received a protest from the second lowest bidder-Maggiora & Ghilotti regarding
some irregularities in the bids submitted by the lowest bidder -Able General Engineering. Under
the San Rafael Municipal Code Section 11.50.100, the City has the sole discretion to reject all
bids. Due to these irregularities in the bids, Public Works staff concluded that it would be in the

best interest of the City to reject all bids. Staff will reevaluate and make adjustments to the
project and rebid the project at some future date.
ACTION REQUIRED:
Staff recommends that the City Council reject all bids, and authorize staff to rebid the project in
the spring of 2011.
