LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify tha the foregoing Charter Ordinance No. 1511 entitled: "AN INTERIM URGENCY ZONING ORDINANCE OF THE CITY OF SAN RAFAEL ENACTING A MORATORIUM ON FORTUNETELLING BUSINESS" is a true and correct copy of an Interim Urgency Ordinance of said City and was introduced and adopted at a Regular meeting of the City Council of the City of San Rafael, held on the Fifth day of August, 1985, and published as required by City Charter in the Independent Journal, a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a Regular meeting of the City Council of said City held on the Fifth day of August, 1985, by the following vote, to wit: AYES: COUNCILMEMBERS: Breiner, Nave, Russom & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Frugoli WITNESS my hand and the official seal of the City of San Rafael this 14th day of AUGUST , 1985. JEANN(P.`LEONCINI,C tyClerk ORDINANCE NO. 1511 AN INTERIM URGENCY ZONING ORDINANCE OF THE CITY OF SAN RAFAEL ENACTING A MORATORIUM ON FORTUNETELLING BUSINESS. THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ORDAINS AS FOLLOWS: SECTION 1: Fortunetelling, as defined below, is hereby prohibited within the City during the term of this interim ordinance and any extensions thereof. "Fortunetelling," as used in this ordinance, shall include astrology, palmistry, phrenology, lifereading, fortunetelling, cartomancy, clairvoyance, clairaudience, crystal gazing, mediumship, spirit materialization, etherealization, prophecy, augury, divina- tion, magic, necromancy, fortunetelling by handwriting analysis, or other similar business or act. SECTION 2: This Interim Ordinance is adopted as an urgency measure to prohibit any uses which may be in conflict with a con- templated zoning proposal concerning fortunetelling which the City Council, Planning Commission, or Planning Department is considering or studying or intends to study within the term of this Ordinance. This Ordinance shall be of no further force and effect forty-five (45) days from the date of its adoption unless extended pursuant to Government Code Section 65858. SECTION 3: The City Council finds that there is a current and immediate threat to the public health, safety or welfare and that the approval of additional subdivisions, zonings, land use permits, variances, building permits or any other applicable en- titlement for use which is required in order to comply with the Zoning Ordinance, would result in a threat to public health, safety, or welfare, in that the City is currently considering repealing an existing ban on fortunetelling and there is no existing zoning regulation for the location and standards applicable to fortunetell- ing businesses. The unregulated establishment of fortunetelling businesses within the City would result in a threat to public health, safety, or welfare and a reasonable time is needed for the ORDINANCE NO. 1511 City to study appropriate zoning classifications and regulations for fortunetelling businesses. _""i, U,�,e,..
