LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1514 entitled: "AN INTERI14 URGENCY ORDINANCE EXTENDING FOR SIX MONTHS ORDINANCE NO. 1511 (MORATORIUM ON FORTUNE-TELLING BUSINESSES) AND PROHIBITING ANY USES WHICH MAY BE IN CONFLICT WITH THE CONTEMPLATED ZONING PROPOSAL" is a true and correct copy of an Interim Urgency Ordinance of said City and was introduced and adopted at a Regular meeting of the City Council of the City of San Rafael, held on the Sixteenth day of September, 1985, and published as required by City Charter in the Independent Journal, a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a Regular meeting of the City Council of said City held on the Sixteenth day of September, 1985, by the following vote, to wit: AYES: COUNCILMEMBERS: Frugoli, Nave, Russom & Vice -Mayor Breiner NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Mayor Mulryan WITNESS my hand and the official seal of the City of San Rafael this 24th day of September , 1985. JEANNE LEONCINI, City Clerk ORDINANCE NO. 1514 AN INTERIM URGENCY ORDINANCE EXTENDING FOR SIX MONTHS ORDINANCE NO. 1511 (MORATORIUM ON FORTUNE-TELLING BUSINESSES) AND PROHIBITING ANY USES WHICH MAY BE IN CONFLICT WITH THE CONTEMPLATED ZONING PROPOSAL THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS: SECTION 1: San Rafael Ordinance No. 1511, adopted on August 5, 1985, is hereby extended, pursuant to California Government Code Section SECTION 2: This Ordinance, if passed, shall, by operation of law, be of no further force and effect six months from the date of its adoption; provided, however, that after notice and public hearing the City Council may extend this Interim Urgency Ordinance for one year. SECTION 3: The City Council finds that there is a current and immediate threat to the public health, safety or welfare and that the approval of additional subdivisions, zonings, land use permits, variances, building permits or any other applicable entitlement for use which is required in order to comply with the Zoning Ordinance, would result in a threat to public health, safety, or welfare, in that the City is currently considering repealing an existing ban on fortunetelling and there is no existing zoning regulation for the location and standards applicable to fortunetelling businesses. The unregulated establishment of fortunetelling businesses within the City would result in a threat to public health, safety, or welfare and a reasonable time is needed for the City to study appropriate zoning classifications and regulations for fortunetelling businesses.
