the foregoing Charter Ordinance No. 1520 entitled:

ORDINANCE NO. 1520
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL DECLARING A NEED FOR AN INDUSTRIAL
DEVELOPMENT AUTHORITY AND DECLARING THAT SUCH
AUTHORITY SHALL FUNCTION
WHEREAS, there exists within the City of San Rafael econ-
omically distressed communities and areas which may be benefited by
efforts to prevent the loss of existing jobs and to create new jobs;
and
WHEREAS, in the interest of the health, welfare and safety
of the people of the City of San Rafael and of the State of
California, it is necessary to provide an alternative method of
financing certain facilities in order to prevent the loss of existing
jobs in such City of San Rafael and to increase employment opportun-
ities and otherwise contribute to the economic development of such
City of San Rafael; and
WHEREAS, the California Industrial Development Financing
Act, California Government Code Sections 91500, et seq. (the "Act"),
has created in the City of San Rafael a public, corporate instrumen-
tality of the State of California known as the Industrial Development
Authority of the City of San Rafael, for the purpose of exercising
powers granted by the Act; and
WHEREAS, Section 91520(b) of the act provides that said
authority shall not transact any business or exercise any powers
under the Act unless, by ordinance, this City Council declares that
there is a need for such authority and that the authority shall
function.
THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
Section 1. It is hereby found and declared that there is
a need for the Industrial Development Authority of the City of San
Rafael (the "Authority") created by Section 91520(a) of the Act and
that the Authority shall function in the City of San Rafael, and the
Authority is hereby authorized to transact business and to exercise
all powers permitted by law.

Section 2. Pursuant to Section 91520(b) of the Act, this
Ordinance is subject to the provisions for referendum set forth in
Sections 3753 through 3756 of the California Elections Code.
Section 3. If any section, subsection, sentence, clause
or phrase of this Ordinance is for any reason held to be invalid,
such decision shall not affect the validity of the remaining portions
of this Ordinance. The Council hereby declares that it would have
adopted the Ordinance and each section, subsection, sentence, clause
or phrase thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses or phrases be declared
invalid.
Section 4. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation,
published, and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days after its final passage.

The foregoing Ordinance No. 1520 was read and intro-
duced at a Regular meeting of the City Council of the City of
San Rafael, held on the 18th day of November , 1985, and
ordered passed to print by the following vote, to wit:
