LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1535 entitled: "AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING SAN RAFAEL MUNICIPAL CODE SECTION 2.16.028(1) & (27) ENTITLED "REGULATION OF USE OF PARK AND/OR RECREATION FACILITIES" OF CHAPTER 2.16 OF TITLE 2" is a true and correct copy of an ordinance of said City and was introduced at a Regular meeting of the City Council of the City of San Rafael, held on the Seventeenth day of February 1987, published as required by City Charter in the Marin Independent Journal , a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a Reaular meeting of the City Council of said City held on the Second day of March 1987, by the following vote, to wit: AYES: COUNCILbiEMBERS Greiner, Frugoli, Nave & Mayor Mulryan NOES: COUNCILMEMBERS:None ABSENT: COUNCILREM13ERS:None WITNESS my hand and the official seal of the City of San Rafael this Fourth day of March 1987. , JEANN 7LEONCINI, City Clerk ORDINANCE NO. 1535 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING SAN RAFAEL MUNICIPAL CODE SECTION 2.16.028(1) & (27) ENTITLED "REGULATION OF USE OF PARK AND/OR RECREATION FACILITIES" OF CHAPTER 2.16 OF TITLE 2 THE COUNCIL OF THE CITY OF SAN RAFAEL DOES ORDAIN AS FOLLOWS: SECTION 1. Title 2, Chapter 2.16, Section 2.16.028 entitled "Regulation of Use of Park and/or Recreation Facilities" Subsection (1) and (27) of the Municipal Code of the City of San Rafael are hereby amended as follows: 2.16.028(1) (1) With the exception of specifically night -lighted facilities including, but not limited to, City tennis courts and ballfields, no person shall be allowed to enter, loiter, or remain in or on any City park and/or recreation facility or open space land any later than one half hour after sunset or earlier than one half hour before sunrise, without the prior written approval or authorization of the City Manager or his designee. 2.16.028(27) (27) Any person who is convicted of a violation of any of the provisions of this section is guilty of an infraction and shall be punishable by a fine as established by Resolution of the City Council. SECTION 2. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion of this ordinance. The City Council of the City of San Rafael hereby declares that it would have adopted the ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases shall be declared invalid. SECTION 3. This ordinance shall be published once in full before its final passage in a newspaper of general circulation, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage.
