LEONCINI, Clerk of the City of San Rafael, and Ex -officio Clerk of the Council of said City, do hereby certify that the foregoing Charter Ordinance No. 1468 entitled: ORDINANCE PROVIDING FOR THE EXCHANGE AND CONVEYANCE OF PUBLIC REAL PROPERTY (Vicinity of Bellam Blvd.) is a true and correct copy of an ordinance of said City and was introduced at a regular meeting of the City Council of the City of San Rafael, held on the third day of October , 1983, published as required by City Charter in the Indenendent-Journal a newspaper published in the City of San Rafael and passed and adopted as an ordinance of said City at a regular meeting of the City Council of said City held on the seventeenth day of October , 1983, by the following vote, to wit: AYES: COUNCILKEMBERS: Breiner, Frugoli, Jensen & Mayor Mulryan NOES: COUNCILMEN1BERS: None ABSENT: COUNCILIMEMBERS: Miskimen WITNESS my hand and the official seal of the City of San Rafael this nineteenth day of October 19 83 JE �Di. LI;ONCINI , City Clerk ORDINANCE NO. 1468 ORDINANCE PROVIDING FOR THE EXCHANGE AND CONVEYANCE OF PUBLIC REAL PROPERTY (Vicinity of Bellam Blvd.) The Council of the City of San Rafael, California, do ordain as follows: SECTION 1: It is hereby found, determined, and ordained that real property being a portion of Assessor's Parcel 09-280-01, as described in Exhibit "A" attached hereto, in San Rafael, California, has been reviewed by the Planning Commission and determined that the exchange of this lot will not have an adverse effect on vicinity properties or the general welfare of the community, and that it would be in the best interests of the City of San Rafael, California, to exchange all of the real property described in Exhibit "A" attached. SECTION 2: The City of San Rafael, California, a municipal corporation, hereinafter referred to as "City", by and through its City Council, does hereby declare its intention to exchange said real property subject to any and all unpaid taxes, assessments, easements,rights-of-way, restrictions, reservations, conditions, deeds of trust, liens and encumbrances thereon of any nature or kind whatsoever, for property owned by the San Rafael Sanitation District described in Exhibit "B" attached, upon the following terms and conditions. 1. Escrow. Within ten (10) business days (Saturdays and Sundays not being business days) from the effective date of this ordinance, an escrow shall be opened with a title company agreeable to both parties to this agreement, in the City of San Rafael, California, on the following terms and conditions: A.) That all escrow charges, are to be equally divided between the City of San Rafael and the San Rafael Sanitation District. B.) That all escrow instructions shall be written on the current forms in use by the selected title company. C.) That the cost of any title insurance policy or policies is to be borne equally by the City of San Rafael and the San Rafael Sanitation District. ORDINANCE NO. 1468 D.) That the said escrow shall be closed on or before twenty-one (21) business days following the day upon which an ordinance in compliance with Article VII, Section 7, of the San Rafael Charter, is effective. 2. Delivery of Possession. Possession of parcel(s) shall be given at the close of escrow. 3. Condition of Title. Title shall be subject to those terms and conditions approved by the Planning Commission at its meeting of October 12, 1982, details of which are available at the City of San Rafael, Planning Department, 1400 Fifth Avenue, San Rafael, California. 4. Description of Property. That certain real property situate in the City of San Rafael, County of Marin, State of California, commonly referenced to as portions of A.P. 09-280-01 and portion 09-010-02 fully described in Exhibit "A" and Exhibit "Bn attached hereto and forming a part hereof. SECTION 3: The Mayor of the City of San Rafael is authorized and directed to execute and deliver deeds of conveyance in the name of said City to the San Rafael Sanitation District which are necessary and proper to carry out the Exchange, upon the terms and conditions herein provided, upon receipt of the property described in Exhibit "B" and other considerations, all as hereinabove set forth. SECTION 4: This ordinance shall be published once in full before its final passage, in a newspaper of general circulation, published and circulated in said City, and shall be in full force and effect thirty (30) days after its passage. 7 �OHN._MISKIMEN, Acting Mayor ATTEST: � JEA M. A parcel of land in the City of San Rafael, County of Marin, State of California, being a portion of Lot 1, as said Lot is shown on the map entitled "Bahia de Rafael Industrial Park", filed in the Office of the Recorder of Marin, California, on February 13, 1973 in Book 15 Maps at Page 54, more particularly described as follows: Beginning at a point on the southerly line of Lot 1, as said Lot is shown on the above-named Map, distant theron 50.000 feet from the most southeasterly corner of Lot 1; thence continuing along said southerly line, N 69032'00"W, 60.002 feet; thence N 20000'00"E, 100.739 feet; thence along the arc of a curve, tangent to the preceeding course, with radius of 20.000 feet, through a central angle of 90000'00", and an arc length of 31,416 feet; thence tangent to the preceeding curve, S 70000'00"E, 87.736 feet to the northeasterly of Lot 1 as shown on the above-named Map; thence S 8005'00"W, 3.715 feet to a point on a curve; thence along the arc of a curve to the left whose radial bears S15°05'25"E, with a radius of 20.00 feet, through a central angle of 54154'35", and an arc length of 19.167 feet; thence tangent_ to the preceeding curve, S 20°00'00"W, 101.228 feet to the point of beginning. EXHIBIT B Description Parcel of Land from S.R.S.D. to City of San Rafael A parcel of land in the City of San Rafael, County of Marin, State of California, being a portion of Lot 11, Block 30 as said Lot is shown on the map entitled "Map of East San Rafael", filed in the Office of the Recorder of Marin, California, on January 21, 1908 in Book 2 of Maps at page 109, more particularly described as follows: Beginning at the northeasterly corner of Lot 11, Block 30 as shown on the above-named Map, also being the most southeasterly corner of Lot 1, as shown on the "Map of Bahia de Rafael Industrial Park" filed in the Office of the County Recorder of Marin, California on February 13, 1973 in Book 15 of Maps at page 54; thence along the line common to Lot 10 and 11, N 69132'00"W, 50.000 feet; thence S 20000'00"W, 112.000 feet; thence S 70100'00"E, 95.198 feet to the northeasterly of Lot 11, Block 30 as shown on the "Map of East San Rafael";thence N 2003'00"W, 120.399 feet to the point of beginning.
