introduced at a regular meeting of the City Council
of the City of San Rafael, held on the fifth day of
March , 1984, published as required by City Charter in the
NEWS/POINTER a newspaper published in the City
of San Rafael and passed and adopted as an ordinance of said City at
a regular meeting of the City Council of said City
held on the fifth day of March1984 by the following
vote, to wit:

ORDINANCE NO. 1478
AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING
ORDINANCE 1476 OF THE ZONING MAP OF THE CITY OF
SAN RAFAEL ADOPTED FEBRUARY 6, 1984, SO AS TO
AMEND CONDITION OF APPROVAL (b)(6) of EXHIBIT 'A'.
(Irwin Street, West of Bret Harte Village)
THE CITY COUNCIL OF SAN RAFAEL DOES ORDAIN AS FOLLOWS:
DIVISION 1. Ordinance 1476 of the Zoning Map reclass-
ifying real property along Irwin Street, west of Bret Harte Village,
San Rafael, County Assessor's Parcel 13-271-29, was adopted subject
to conditions outlined in Exhibit 'A' of that ordinance. Ordinance
1476 is hereby amended so as a change in wording to condition (b)
(6) of Exhibit 'A' reads as follows:
(b)(6) The CC&Rs for the Homeowners Association
shall establish a sinking fund for the future main-
tenance and/or replacement of facilities. The asso-
ciation shall contract with a professional firm to
provide regular maintenance of all on-site drainage
facilities. The name and telephone number of this
professional firm shall be made available to the City's
Public Works Department. Additionally, the City shall
have the right to enforce the maintenance of said
facilities at the Homeowner Association's expense.
DIVISION 2. This Ordinance shall be published once
in full before its final passage in a newspaper of general circula-
tion, published and circulated in the City of San Rafael, and shall
be in full force and effect thirty (30) days after its final
passage.

The foregoing Ordinance No. 1478 was read and intro-
duced at a regular meeting of the City Council of the City of
San Rafael, held on the 21st day of February , 1984, and
ordered passed to print by the following vote, to wit:
AYES: COUNCILMEMBERS:Breiner, Frugoli, Nave, Russom & Mayor Alulryan
NOES: COUNCILMEMBERS:None
ABSENT: COUNCILMEMBERS:None
and will come up for adoption as an Ordinance of the City of San
Rafael at a regular meeting of the Council to be held on the
fifth day of March , 1984.
