the foregoing Charter Ordinance No. 1481 entitled:
AN ORDINANCE OF THE CITY OF SAN RAFAEL PROVIDING FOR THE SALE AND
CONVEYANCE OF PUBLIC REAL PROPERTY TO THE SAN RAFAEL REDEVELOPMENT

ORDINANCE NO.1481
AN ORDINANCE OF THE CITY OF SAN RAFAEL PROVIDING FOR
THE SALE AND CONVEYANCE OF PUBLIC REAL PROPERTY TO
THE SAN RAFAEL REDEVELOPMENT AGENCY
(Jacoby Street)
THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. It is hereby determined and ordained that the
real property being those vacated portions of street right-of-way
situated at the easterly terminus of Jacoby Street as more par-
ticularly described in "Exhibit All attached hereto, in San Rafael,
California, is surplus to the City and can serve a greater public
purpose by the assembly with adjoining lands to provide a site for
planned future development, and that it would be in the best interest
of the City of San Rafael, California, to sell all of the real
property hereinafter described.
DIVISION 2. The City of San Rafael, California, a muni-
cipal corporation, hereinafter referred to as "City", by and through
its City Council, does hereby sell the land referred to in Division 1
above and hereinafter specifically described, to the San Rafael
Redevelopment Agency, a public body, corporate and politic hereinafter
referred to as "Buyer", upon the following terms and conditions:
1. Purchase Price. The purchase price to be paid by
Buyer to City shall be the sum of one hundred and five
thousand and No/100 ($105,000.00) in cash lawful
money of the United States of America, payable upon
subsequent public sale by the Redevelopment Agency
of the assembled parcels.
2. Delivery of Possession. Buyer shall be given
possession of said real property upon recordation of
the deed of conveyance.
3. Compliance with San Rafael Charter. It is
understood that the within sale is subject to Sub-
division 7 of Section 7 of Article VII of the
San Rafael Charter, and it is agreed that the within
sale shall be made in compliance with said Charter
provisions.

4. Condition of Title. Title shall be subject to
covenants, conditions, restrictions, reservations,
rights, rights-of-way and easements now of record
and to all of the provisions of this Agreement of
Sale, and the property is sold as an "as is" con-
dition.
5. Description of Property. That certain real
property situate in the City of San Rafael, County
of Marin, State of California, as described in
Exhibit "A" attached hereto.
DIVISION 3. The Mayor of the City of San Rafael is auth-
orized and directed to execute and to deliver to the San Rafael
Redevelopment Agency, a public body, corporate and politic, a deed of
conveyance in the name of said City necessary and proper to carry out
the sale, upon the terms and conditions herein provided, upon receipt
of the purchase price and other considerations, all as hereinabove
set forth.
DIVISION 4. This Ordinance shall be published once in full
before its final passage in a newspaper of general circulation,
published and circulated in the City of San Rafael, and shall be in
full force and effect thirty (30) days after its final passage.

The foregoing Ordinance No. 1481 was read and intro-
duced at a regular meeting of the City Council of the City of
San Rafael, held on the 2nd day of April , 1984, and
ordered passed to print by the following vote, to wit:
AYES: COUNCILMEMBERS:Breiner, Frugoli, Nave, Russom & Mayor Mulryan
NOES: COUNCILMEMBERS:None
ABSENT: COUNCILMEMBERS:None
and will come up for adoption as an Ordinance of the City of San
Rafael at a regular meeting of the Council to be held on the
16th day of April , 1984.

All that certain real property situate in the City of
San Rafael, County of Marin, State of California, des-
cribed as follows:
Being a portion of Parcel "A" as shown upon that certain
map entitled "Parcel Map, Lands of Quail Hill, Inc.,
being portion of Parcel "A" 8 o.s. 76 as recorded in Book
15 of Parcel Maps at page 38, Marin County Records and
described as follows:
Beginning at the northeasterly corner of Parcel "A" as
shown upon the aforementioned map, thence along the
boundary of said Parcel "A" S15052129" W, 30.04 ft.;

"Record of Survey of a portion of Section 2, 3, 10 & 11,
T. IN., R. 6W., Mount Diablo Meridian, San Rafael,
California" (8 O.S. 76)" as recorded September 7, 1977 in
Book 14 of Parcel Maps at page 24, Marin County Records,
said point being the intersection of the courses "South
15152'29" West, 721.323 feet", and "South 52028'00" East,
138.19 feet" as shown on said Parcel Map (14 P.M. 24);
thence along the southerly boundary of said Parcel 1 (14
P.M. 24) the following courses and distances; South
