the foregoing Charter Ordinance No. 1483 entitled:

introduced at a regular meeting of the City Council
of the City of San Rafael, held on the sixteenth day of

of San Rafael and passed and adopted as an ordinance of said City at

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL AMENDING SECTIONS 14.08.130,
14.40.020IIa, 14.44.020IIa, 14.46.040f,
14.47.020IIb, AND 14.56.025m OF THE SAN RAFAEL
MUNICIPAL CODE TITLE 14 CONCERNING REGULATION OF
LATE NIGHT CONVENIENCE MARKETS AS CONDITIONAL USES
THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS:
DIVISION 1. Title 14 (Zoning) of the San Rafael Muni-
cipal Code is hereby amended to read as follows:
Section 14.08.130 "Definitions" is amended to add the
following definition under "L":
"Late night convenience market: is any store
which sells retail convenience or grocery items
and which is open to the public past 11:00 PM
or prior to 6:00 AM".
Section 14.40.020IIa, 11C-1: Restricted Com-
mercial District" is amended to read as follows:
a. Retail stores and personal service estab-
lishments within a building, including appl-
ance stores, bakeries, banks, barber shops,
beauty parlors, book stores, department
stores, drug stores, florist shops, food
shops, hardware stores, late night conven-
ience markets, mortuaries, offices, photo-
graphic studios, radio stores, restaurants,
shoe shops, tailor shops, and other uses
which in the opinion of the Planning Com-
mission are of similar nature.
Section 14.44.020IIa, 11C-2: General Commercial District"
is amended to read as follows:
a. Ambulance service, animal hospitals, auto-
mobile repair shops, cleaning and dyeing
establishments, creameries, discos, gaso-
line service stations, laundries, launder-
ettes, live entertainment, outdoor markets,
outdoor sales establishments, marine uses,
pet shops, public garages, used car lots,
fast food establishments, theaters, com-
mercial recreation uses contained entirely
within a building, establishments selling
prepared food intended for consumption on
the premises in a vehicle, late night con-
venience markets, and other uses which, in
the opinion of the Planning Commission, are
of a similar nature.
Section 14.46.040, "C-3: Retail Commercial District" is
amended to add the following:
f. Late night convenience markets.

Section 14.47.020IIb, "C-4: Downtown Commercial District"
is amended to read as follows:
b. Ambulance service, animal hospitals, auto-
mobile repair shops, cleaning and dyeing

line service stations, laundries, launder-
ettes, live entertainment, outdoor markets,
outdoor sales establishments, marine uses,
pet shops, public garages, used car lots,
fast food establishments, yacht harbors,
establishments selling prepared food intended
for consumption on the premises in a
vehicle, late night convenience markets, and
other uses which, in the opinion of the
Planning Commission, are of a similar nature.
Section 14.56.025, I'M: Heavy Commercial and Manufacturing
District" is amended to add the following:
m. Late night convenience markets.
DIVISION 2. If any section, subsection, sentence, clause
or phrase of this Ordinance is for any reason held to be invalid,
such decision shall not affect the validity of the remaining por-
tions of this Ordinance. The Council hereby declares that it would
have adopted the Ordinance and each section, subsection, sentence,
clause or phrase thereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be
declared invalid.
DIVISION 3. This ordinance shall be published once in
full before its final passage, in a newspaper of general circula-
tion, published and circulated in said City, and shall be in full
force and effect thirty (30) days after its passage.

The foregoing Ordinance No. 1483 was read and intro-
duced at a regular meeting of the City Council of the City of
San Rafael, held on the 16th day of April , 1984, and
ordered passed to print by the following vote, to wit:
AYES: COUNCILMEMBERS: Frugoli, Nave, Russom & Mayor Mulryan
NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS:Breiner
and will come up for adoption as an Ordinance of the City of San
Rafael at a regular meeting of the Council to be held on the
7th day of May , 1984.
